L'article 9 du traité sur l'Union européenne stipule que ".l'Union respecte le principe de l'égalité de ses citoyens, qui bénéficient d'une égale attention de ses institutions, organes et organismes" et le Code européen de bonne conduite administrative du Médiateur européen stipule que "lors de la prise de décisions, le fonctionnaire respecte le juste équilibre entre les intérêts des personnes privées et l'intérêt public général".

Une décision, prise à titre volontaire par une autre institution que celle dont émane l'intéressé, d’étendre les effets juridiques d’un arrêt à l’ensemble de ses fonctionnaires ne saurait donc être considérée comme un fait nouveau permettant à l'intéressé de présenter une demande de réexamen de la décision administrative le concernant.
A decision, adopted voluntarily by an institution other than the institution of the person concerned, to extend the legal effects of a judgment to all its officials cannot therefore be considered to be a new fact enabling the person concerned to request a review of the administrative decision concerning him.

Whereas the Disciplinary Committee rules on any breach of duty by the official concerned, particularly in the light of his obligations under the Staff Regulations and, more generally, compliance with EU law, and its opinion may lead the official’s institution to adopt a decision which may be favourable or unfavourable to him, the situation is entirely different with the decision to communicate information, since OLAF merely communicates to the national judicial authorities information which those authorities alone are responsible for assessing from the point of view of criminal law.
