Earlier this month the Commission questioned UKE's decision to merely publish non-binding recommended MTRs on its website rather than legally binding and immediately enforceable regulatory decisions (see IP/11/1308 ).

1. (Return tabled) Question No. 611 Ms. Kirsty Duncan: With respect to the government’s plans for resource development, as described in the section entitled “Responsible Resource Development” in Chapter 3.2 of Budget 2012: (a) what are all examples of federal environmental laws that are stronger than provincial laws and how will the proposed legislative changes to the Canadian Environmental Assessment Act (CEAA) affect the assessment of environmental impacts of industrial projects that cross provincial borders; (b) what research, action, or investment has the government undertaken to study impacts of the proposed legislative changes to the CEAA on (i) regulatory decision-making, (ii) risk of project-specific and cumulative environmental impacts, (iii) risk mitigation by developers, (iv) Canada’s reputation; (c) what briefing notes, memos, or any other documentation, including, for each, the details of its findings and recommendations, have been provided to the Prime Minister, Minister of Natural Resources, Minister of the Environment, their respective Parliamentary Secretaries, their respective Deputy Ministers, and their respective staff members, regarding impacts of the proposed legislative changes to the CEAA on (i) regulatory decision-making, (ii) risk of project-specific and cumulative environmental impacts, (iii) mitigation by developers, (iv) Canada’s reputation; (d) will the proposed legislative changes to the CEAA give any consideration to (i) measuring negative impacts of development, (ii) managing negative impacts of development; (e) by what date will the government bring forth new “legislation to streamline the review process for major economic projects” (Budget 2012, p. 89); (f) what are the projected costs of changes to the CEAA for each province and territory; (g) what assessments of the adequacy of the environmental assessment process in each province and territory have been conducted, (i) what were the dates of any such assessments, (ii) what wer ...

B. whereas the mandate of the Committee of Inquiry set up pursuant to Decision 2006/469/EC was to: (1) investigate alleged contraventions or maladministration in the application of Council Directive 92/96/EEC of 10 November 1992 on the coordination of laws, regulations and administrative provisions relating to direct life assurance and amending Directives 79/267/EEC and 90/619/EEC (third life assurance Directive) , now codified by Directive 2002/83/EC of the European Parliament and of the Council of 5 November 2002 concerning life assurance , by the United Kingdom's competent authorities in relation to the Equitable Life Assurance Society (Equitable Life), notably as regards the regulatory regime and the monitoring of the financial health of insurance undertakings, including their state of solvency, the establishment of adequate technical provisions and the covering of those provisions by matching assets; (2) assess whether the Commission had properly fulfilled its duty to monitor the correct and timely transposition of Community law and identify whether systematic weaknesses contributed to the situation that had arisen; (3) assess allegations that the UK regulators consistently failed, over a number of years, and at least since 1989, to protect policy holders by exercising rigorous supervision of accounting and provisioning practices and the financial situation of Equitable Life; (4) assess the status of claims by non-UK European citizens and the adequacy of remedies available under UK and/or EU legislation for policy-holders from other Member States; and (5) make any proposals that it deemed to be necessary in this matter,

When applying the first of its two cumulative criteria, the Commission correctly held in points 17 and 21 of the contested decision, without having previously considered the question whether the relevant Belgian provisions were compatible with Community law, that Belgacom could legitimately refer to those provisions, in the case of its first action, so long as they had not been invalidated and, in the case of its second action, so long as the absence of an implementing decree had not been held to be unlawful.
