Lorsque le module C de l’annexe II de la décision no 768/2008/CE est utilisé pour ce qui est de l’évaluation de la conformité avec les exigences de la présente directive en matière d’émissions gazeuses et lorsque le fabricant ne met pas en œuvre un système de qualité adéquat tel que décrit dans le module H de l’annexe II de la décision no 768/2008/CE, un organisme notifié choisi par le fabricant effectue ou fait effectuer des contrôles du produit à des intervalles aléatoires qu’il détermine afin de vérifier la qualité des contrôles internes du produit.
5. When Module C of Annex II to Decision No 768/2008/EC is used, with regard to the assessment of conformity with the exhaust emission requirements of this Directive and if the manufacturer is not working under a relevant quality system as described in Module H of Annex II to Decision No 768/2008/EC, a notified body chosen by the manufacturer shall carry out product checks or have them carried out at random intervals determined by that body, in order to verify the quality of the internal checks on the product.

The level of maturity of the market for the constituents to which this Regulation applies is such that their conformity or suitability for use can be satisfactorily assessed through internal production control, using procedures based on Module A of Decision No 768/2008/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products, and repealing Council Decision 93/465/EEC (3).
