À cet effet, l’Agence adhère à l’accord interinstitutionnel du 25 mai 1999 entre le Parlement européen, le Conseil et la Commission des Communautés européennes relatif aux enquêtes internes effectuées par l’Office européen de lutte antifraude (OLAF) et elle arrête les dispositions appropriées applicables au personnel de l’Agence et aux experts nationaux détachés en ayant recours à la décision modèle figurant à l’annexe dudit accord.
To that end, the Agency shall accede to the Interinstitutional Agreement of 25 May 1999 between the European Parliament, the Council and the Commission of the European Communities concerning internal investigations by the European Anti-Fraud Office (OLAF) and shall issue the appropriate provisions to the staff of the Agency and to seconded national experts using the model decision in the Annex to that Agreement.

Welcomes the Decision of the Management Board, adopted on 11 January 2011, concerning the terms and conditions for internal investigations in relation to the prevention of fraud, corruption and illegal activity detrimental to the Union's interests; stresses that this Decision follows closely the text of the model decision annexed to the Interinstitutional Agreement of 25 May 1999, and represents the accession of the Authority to that agreement;

The model decision attached to the Interinstitutional Agreement of 25 May 1999 between the European Parliament, the Council and the Commission, and, as regards Commission officials, Decision 1999/396, both of which concern the terms and conditions for internal investigations in relation to the prevention of fraud, corruption and any illegal activity detrimental to the Communities’ interests, merely require, in the second paragraph of Article 4, that the Secretary-General of the institution must agree that the obligation to invite the person concerned to give his views may be deferred where the needs of the investigation require.

28. rejette le projet de mémorandum d'accord prévoyant l'établissement d'un code de pratique pour l'échange d'informations entre l'OLAF et la Commission, estimant qu'un tel code est contraire à la réglementation actuellement en vigueur et, partant, porte atteinte aux compétences de l'OLAF; estime que les dispositions qui régissent la communication d'informations devraient éventuellement être réexaminées dans le contexte d'un règlement révisé; insiste pour que l'obligation d'informer l'OLAF soit inscrite dans le statut des fonctionnaires, conformément à l'article 2 de la "décision modèle"; insiste pour que le directeur de l'OLAF détermine le contenu des informations en prenant pour critères la protection des droits de la personne concernée, la nécessité de conduire une enquête efficace et effective et le besoin de protéger les institutions de l'UE contre d'éventuelles pertes financières à l'avenir; invite la Commission et l'OLAF à examiner l'opportunité de créer un poste d'avocat-conseil; estime qu'il appartient à chaque institution de l'UE de réglementer en toute autonomie la manière dont elle traite les informations transmises par l'OLAF, en garantissant le respect des critères définis;
28. Rejects the draft memorandum of understanding in which a code of practice for the exchange of information between OLAF and the Commission is set out, because it infringes upon the Regulation currently in force and, therefore, on OLAF's remit; believes that the provisions governing the forwarding of information should perhaps be reviewed in the context of a revised regulation; insists that the notification of OLAF should be enshrined in the Statute pursuant to Article 2 of the standard decision; insists that the head of OLAF should determine the content of the information, taking as criteria the protection of the rights of the person concerned, the need for an effective and efficient investigation to be carried out, and the need for the EU institutions to be protected against any financial loss in future; calls on the Commission and OLAF to check whether it would be worthwhile to create the post of a legal officer; considers that each EU institution should lay down rules governing the way in which it deals with information received from OLAF, ensuring that it respects these criteria;

26. invite l'ensemble des organes, institutions et offices qui ne l'ont pas fait à adhérer sans délai à l'accord interinstitutionnel que le Parlement européen, le Conseil et la Commission ont signé le 25 mai 1999 ; demande instamment que les décisions internes soient conformes à la lettre de la décision modèle reprise dans l'annexe à l'accord interinstitutionnel; attache de l'importance à ce que tout fonctionnaire puisse s'adresser directement à l'OLAF sans informer son supérieur hiérarchique; demande que la Commission présente avant le 31 décembre 2003 un rapport indiquant dans quelle mesure cet accord doit être adapté en fonction de la jurisprudence de la Cour de justice, des décisions du Médiateur et de la réforme du statut des fonctionnaires;

Calls on all bodies, institutions and offices, if they have not already done so, to accede without delay to the Interinstitutional Agreement signed on 25 May 1999 by the European Parliament, the Council and the Commission ; insists that internal decisions must follow the wording of the standard decision in the annex to the Interinstitutional Agreement; insists that any employee must be able to address OLAF directly, without informing their hierarchical superior; calls on the Commission to present a report by 31 December 2003 on the ways in which this Agreement must be adapted in the light of Court of Justice case-law, the decisions of the Ombudsman and the reform of the Staff Regulations;
