An assessment has been carried out confirming the relevance and appropriateness of the current ecological criteria, as well as of the related assessment and verification requirements, established by Decisions 2009/568/EC, 2011/333/EU, 2011/381/EU, 2012/448/EU and 2012/481/EU.

Il est soutenu à cet égard que, dans la décision attaquée, en affirmant de manière lapidaire que l’erreur contenue dans le titre de la décision modificatrice du 31 décembre 2012 n’a eu aucun effet sur le contenu de la décision elle-même et sur la mise en œuvre du programme, la Commission n’aurait pas tenu compte de la l’importance du fait que les décisions relatives aux frais adoptées par la Région devaient être préalablement contrôlées par la Cour des comptes; que quatre mois se sont écoulés entre l’annonce de la correction et sa réalisation, sans qu’aucune explication ne soit fournie; que ceci a pu susciter le doute que la rectification à effectuer aurait été plus importante que celle annoncée comme se limitant au seul titre de la décision du 31 décembre 2012 et que la Cour des comptes a confirmé que l’action de la Région, qui s’est abstenue d’adopter les engagements avant de connaître officiellement le rectificatif (le 28 mars 2013), était correcte, laissant ainsi entendre que l’action inverse n’aurait pas été correcte.
The applicant claims in that regard that, in tersely confirming in the contested decision that the error in the title of the amending decision of 31 December 2012 had no effect on the content of the decision itself or on the implementation of the programme, the Commission neglected to take into consideration the relevance of the following circumstances: (i) the spending decisions adopted by the Region had to be checked beforehand by the Court of Auditors; (ii) four months had elapsed between the correction being announced and the correction being implemented, without any explanation being provided; (iii) that fact had the potential to arouse the suspicion that the correction to be made was of greater importance than a correction supposedly relating only to the title of the decision of 31 December 2012; and (iv) the Court of Auditors had confirmed that the course of action taken by the Region, which refrained from adopting the commitments until the correction was officially recognised (28 March 2013), was correct, thus giving it to be understood that the opposite course of action would not have been correct.
