(9) The adaptation to Article 290 TFEU of the provisions in Regulation (EC) No 715/2007 which provided for the use of the regulatory procedure with scrutiny carried out by this Regulation should not affect pending procedures in which the committee has already delivered its opinion in accordance with Article 5a of Decision 1999/468/EC before the entry into force of this Regulation.

Where shorter time-limits apply (Article 5a(5)(b) of Council Decision 1999/468/EC laying down the procedures for the exercise of implementing powers conferred on the Commission) and in cases of urgency (Article 5a(6) of Decision 1999/468/EC), the time for scrutiny shall, unless the Chair of the committee responsible objects, start to run from the date of receipt by Parliament of the final draft implementing measures in the language versions submitted to the members of the committee established in accordance with Decision 1999/468/EC.

(2) Conformément à la déclaration du Conseil et de la Commission(6) relative à la décision 1999/468/CE, il convient d'adapter les dispositions relatives aux comités assistant la Commission dans l'exercice de ses compétences d'exécution prévues en application de la décision 87/373/CEE afin de les mettre en conformité avec les dispositions des articles 3, 4 et 5 de la décision 1999/468/CE.
(2) In accordance with the statement of the Council and of the Commission(6) on Decision 1999/468/EC, the provisions relating to committees which assist the Commission in the exercise of its implementing powers, provided for in application of Decision 87/373/EEC, should be adapted in order to bring them into line with the provisions of Articles 3, 4 and 5 of Decision 1999/468/EC.

Since the decision to set up an executive agency is a measure of general scope within the meaning of Article 2 of Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(4), such decisions should be adopted in accordance with Decision 1999/468/EC.

(13) Les mesures nécessaires à la mise en oeuvre de la présente décision étant essentiellement des mesures de gestion, il convient donc que ces mesures soient arrêtées selon la procédure de gestion prévue à l'article 4 de la décision 1999/468/CE du Conseil du 28 juin 1999 fixant les modalités de l'exercice des compétences d'exécution conférées à la Commission(8); étant donné en revanche que les activités de recherche impliquant l'utilisation d'embryons humains et de cellules souches d'embryons humains sont soumises à des paramètres éthiques à établir en fonction de l'évolution des connaissances scientifiques, de l'avis du Groupe européen d'éthique et, le cas échéant, de la législation et des règles nationales et internationales en matière d'éthique, il convient dès lors que les mesures relatives au financement de tels projets soient arrêtées selon la procédure de réglementation prévue à l'article 5 de la décision 1999/468/CE du Conseil.
(13) Since the measures for the implementation of this decision are essentially management measures, and should therefore be adopted by the management procedure provided for in Article 4 of Council Decision 1999/468/EC of 28 June 1999, laying down the procedures for the exercise of implementing powers conferred on the Commission(8); since on the other hand research involving the use of human embryos and human embryonic stem cells is subject to ethical parameters to be established in accordance with the evolution of scientific knowledge, the opinion of the European Group on Ethics, and, where appropriate, national and international ethical legislation and rules; and, therefore, measures for the financing of such projects should be adopted by the regulatory procedure provided for in Article 5 of Council Decision 1999/468/EC.
