L’article 41, paragraphe 1, du protocole additionnel, signé le 23 novembre 1970 à Bruxelles et conclu, approuvé et confirmé au nom de la Communauté économique européenne par le règlement (CEE) no 2760/72 du Conseil, du 19 décembre 1972, portant conclusion du protocole additionnel ainsi que du protocole financier, signés le 23 novembre 1970, annexés à l’accord créant une association entre la Communauté économique européenne et la Turquie et relatif aux mesures à prendre pour leur entrée en vigueur, doit être interprété en ce sens que la clause de «standstill» énoncée à cette disposition s’oppose à une mesure de droit national, introduite après l’entrée en vigueur dudit protocole additionnel dans l’État membre concerné, imposant aux conjoints de ressortissants turcs résidant dans ledit État membre, qui souhaitent entrer sur le territoire de cet État au titre du regroupement familial, la condition de prouver au préalable l’acquisition de connaissances linguistiques élémentaires de la langue officielle de cet État membre.
Article 41(1) of the Additional Protocol, signed in Brussels on 23 November 1970 and concluded, approved and confirmed on behalf of the Community by Council Regulation (EEC) No 2760/72 of 19 December 1972 concluding the additional protocol and the financial protocol signed on 23 November 1970 and annexed to the Agreement establishing an Association between the European Economic Community and Turkey and relating to the measures to be taken for their implementation must be interpreted as meaning that the ‘standstill’ clause set out in that provision precludes a measure of national law, introduced after the entry into force of that additional protocol in the Member State concerned, which imposes on spouses of Turkish nationals residing in that Member State, who wish to enter the territory of that State for the purposes of family reunification, the condition that they demonstrate beforehand that they have acquired basic knowledge of the official language of that Member State.
