a.Reaffirm the EU commitment to increase its focus on ESCR in EU’s external policy, including in its programming of external assistance, while also emphasizing that human rights are indivisible and interlinked, and that the strengthening of the ESCR dimension does not in any way reflect a weakening of existing commitments to Civil and Political Rights; emphasize the clear recognition of the human rights dimension in areas such as social policy, health, education, or standard of living; develop capacity building ensuring that all relevant EU and Member States staff as well as civil society actors, including social partners on the ground are informed of the international treaties related to economic, social and cultural rights, in particular those related to fundamental principles and rights at work (ILO fundamental conventions).

Just to mention a couple, the rollback and standstill provisions that were developed there are in blatant contradiction to the very important principle in social and economic rights of progressive realization, which essentially means that in ratifying the Covenant on Economic, Social, and Cultural Rights, Canada and other state parties are committed to trying to move forward in the protection of social and economic rights, and not to take deliberately retrogressive measures.

Core texts which must be applied for migrants as well as nationals include the Universal Declaration of Human Rights, the International Covenants on Civil and Political Rights and on Economic, Social and Cultural Rights, the 1951 Geneva Convention Relating to the Status of Refugees and the 1967 Protocol to that Convention, the 1954 Convention relating to the Status of Stateless Persons, the 1961 UN Convention on the Reduction of Statelessness, Convention on Rights of the Child, the two UN Palermo Protocols on Smuggling of Migrants and Trafficking in Persons, the International Convention on the Elimination of All Forms of Racial Discrimination, the UN Convention against Torture, and the ILO Convention on decent work for domestic workers.

In his appearance before us, Harinder Mahil, the Acting Chief Commission of the British Columbia Human Rights Commission, reiterated the recommendation of his Commission and of the Canadian Association of Statutory Human Rights Agencies (CASHRA) that Canada’s federal, provincial and territorial human rights codes be amended to include “social condition” as a prohibited ground of discrimination.[48] Such a change has also been recommended by the Canadian Human Rights Act Review Panel in its June 2000 report as well as the Economic, Social, and Cultural Committee in its December 1998 concluding observations on Canada’s Third Report under the International Covenant on Economic, Social, and Cultural Rights.
