Cette situation a été identifiée par le Conseil européen dans le Programme de Stockholm qui invite les institutions de l'UE et les États membres à veiller à ce que les initiatives juridiques restent conformes aux droits fondamentaux « tout au long du processus législatif, en renforçant l'application des méthodes employées pour vérifier de manière systématique et rigoureuse que la convention et les droits énoncés dans la Charte des droits fondamentaux sont bien respectés »[17].
This situation was identified by the European Council in the Stockholm Programme, which calls on the EU institutions and Member States to ensure that legal initiatives remain consistent with fundamental rights " throughout the legislative process by way of strengthening the application of the methodology for a systematic and rigorous monitoring of compliance with the Convention and the rights set out in the Charter of Fundamental Rights "[17].
