Expresses concern at the alarming increase in the number of violations of fundamental rights in the EU, in particular in the areas of immigration and asylum, discrimination and intolerance – especially towards certain communities – and in the number of instances of attacks being carried out and of pressure being exerted on the NGOs which defend the rights of these groups and communities; notes Member States’ unwillingness to ensure that these fundamental rights and freedoms are observed, in particular as regards Roma people, women, the LGBTI community, asylum seekers, immigrants and other vulnerable groups;

4. condamne les tendances préoccupantes des violations des droits fondamentaux au sein de l'Union européenne, notamment en matière d'immigration et d'asile, des faits de discrimination et d'intolérance, notamment vis-à-vis de certaines populations (minorités et migrants), ainsi que dans les domaines de la sécurité et du terrorisme, de la liberté de la presse, de la libre circulation au sein de l'Union et des droits sociaux et syndicaux; constate que les États membres adoptent de plus en plus souvent des attitudes qui font obstacle au respect de ces libertés et droits fondamentaux, notamment en ce qui concerne les Roms, les femmes, les LGBT, les demandeurs d'asile, les migrants et les autres catégories vulnérables de la population;

Condemns the worrying trends with regard to breaches of human rights within the European Union, particularly in the fields of immigration and asylum, and with regard to discrimination and intolerance – especially affecting certain population groups (minorities and migrants) – security and terrorism, freedom of the press, freedom of movement within the Union and social and trade union rights; observes more and more frequently that Member States are adopting obstructive attitudes towards respect for these fundamental rights and freedoms, particularly with regard to Roma, women, LGBT people, asylum-seekers, migrants and other vulnerable population groups;

Notes that ACTA includes provisions on fundamental rights and proportionality both general (e.g. Article 4 and Article 6, Preamble) and specific (e.g. Articles 27(3) and (4)); in this context, indicates, however, that Article 4 covers only disclosure of personal data by Parties and that the references included in Article 27 (3) and (4) should be considered as standard and minimal safeguards; points out that privacy and freedom of expression are not simple principles as referred to in ACTA, but are recognised as fundamental rights by inter alia the International Covenant on Civil and Political Rights, the ECHR, the Charter, and the Universal Declaration of Human Rights;
