Third plea in law: the contested measures restrict the applicant’s fundamental rights in an unjustified and disproportionate manner, in particular his right to property, provided for in Article 1 of the First Additional Protocol to the ECHR and Article 17 of the Charter of Fundamental Rights of the European Union, his right to respect for his good name and reputation, provided for in Articles 8 and 10 of the ECHR, his freedom to engage in work and conduct his business provided for in Articles 15 and 16 of the Charter of Fundamental Rights of the European Union and, lastly, the principle of the presumption of innocence provided for in Article 6 of the ECHR and Article 48 of the Charter of Fundamental Rights of the European Union

se félicite de la communication de la Commission sur la stratégie pour la mise en œuvre effective de la Charte des droits fondamentaux par l'Union européenne, qui fait notamment référence à son approche préventive dans le cadre de la mise en œuvre effective, à l'importance des actions de formation interne sur les droits fondamentaux, à la vérification systématique, par le Comité d’analyse d’impact, des aspects relatifs aux droits fondamentaux dans les analyses d’impact de la Commission, et aux actions de communication ciblée et adaptée aux différentes situations nécessaire dans ce domaine; se félicite également de l'accent que met la Commission dans sa communication susmentionnée sur l'importance des critères politiques pour l'adhésion établis par le Conseil européen de Copenhague en 1993, qui demandent que les pays candidats présentent des institutions stables garantissant la démocratie, la primauté du droit, les droits de l'homme, ainsi que le respect des minorités et leur protection; est d'avis que la préservation de ce critère favorise la protection des droits fondamentaux dans les futurs États membres;
Welcomes the Commission Communication on the Strategy for the effective implementation of the Charter of Fundamental Rights by the European Union referring among others to its preventing approach in the effective implementation, the importance of internal training on fundamental rights, the systematic check of the fundamental rights aspect of the Commission's impact assessments by the Impact Assessment Board, as well as the targeted communication measures tailored to various situations needed in this respect; furthermore welcomes the emphasis of the above-mentioned Commission Communication regarding the importance of the political criteria for accession laid down by the 1993 Copenhagen European Council requiring candidate countries to have stable institutions guaranteeing democracy, the rule of law, human rights and respect for and protection of minorities; the preservation of this criterion is supporting the protection of fundamental rights in the future Member States;

attend des actions plus concrètes du commissaire compétent, conformément aux intentions déjà déclarées: en particulier, et avant toute chose, se félicite de l'engagement à mettre en place une étude d’impact sur les droits fondamentaux de toute nouvelle proposition législative; à surveiller le processus législatif pour faire en sorte que le texte final soit conforme à la Charte; à appliquer une politique de «tolérance zéro» en ce qui concerne les manquements à la Charte, à mener des enquêtes approfondies et à lancer des procédures d’infraction lorsque les États membres ne satisfont pas aux obligations qui leur incombent en matière de droits de l'homme dans le cadre de la mise en œuvre de la législation européenne, et garantir que les citoyens de l'Union européenne sont correctement informés de la nouvelle architecture des droits fondamentaux; demande qu'il soit donné suite à la communication de 2003 sur l'article 7 du traité sur l'Union européenne (COM(2003)0606) qui demandait de définir un moyen transparent et cohérent de réagir aux éventuelles violations des droits de l'homme et d'utiliser de façon pertinente cet article 7 au vu de la nouvelle architecture de l'Union dans le domaine des droits fondamentaux;
Expects concrete actions by the new Commissioner responsible, in line with already declared intentions: particularly and most importantly, welcomes the commitment to introduce a fundamental-rights impact assessment of all new legislative proposals; to oversee the legislative process to ensure that emerging final texts comply with the Charter; to apply a ‘zero tolerance’ policy on violations of the Charter, conducting in-depth investigations and initiating infringement procedures when Member States are in breach of their human rights obligations in implementing EU law; and to make sure EU citizens are properly informed on the new fundamental-rights architecture; calls for follow-up to the 2003 Communication on Article 7 of the Treaty on European Union (COM(2003)0606) to define a transparent and coherent way to address possible violations of human rights and make relevant use of Article 7 TEU on the basis of the new fundamental-rights architecture;

se félicite de l'institution de l'Agence des droits fondamentaux de l’Union européenne et de l'adoption de la décision 2007/252/CE du Conseil du 19 avril 2007 établissant pour la période 2007-2013, dans le cadre du programme général Droits fondamentaux et justice, le programme spécifique «Droits fondamentaux et citoyenneté» , qui vise à promouvoir le développement d'une société européenne fondée sur le respect des droits fondamentaux, y compris les droits dérivés de la citoyenneté de l'Union.
Welcomes the fact that the European Union Agency for Fundamental Rights has been set up and the adoption of Council Decision 2007/252/EC of 19 April 2007 establishing for the period 2007-2013 the specific programme Fundamental rights and citizenship as part of the General programme Fundamental Rights and Justice , the purpose of which is to promote the development of a European society founded on respect for fundamental rights, including the rights deriving from Union citizenship.
