IN-CONTEXT TRANSLATIONS

Au sein de l’Union, la protection des droits fondamentaux est assurée par un système à double niveau: d’une part, le système national fondé sur la constitution de chacun des États membres et les obligations juridiques qui incombent à ceux-ci en vertu d'instruments internationaux, tels que la Convention européenne des droits de l’homme (CEDH); d’autre part, le système de l’Union fondé sur la Charte, lequel ne joue qu’à l'égard des mesures prises par les institutions de l’Union ou lorsque les États membres mettent en œuvre le droit de l’Union.
Within the EU, the protection of fundamental rights is ensured by a two-layered system: the national system based on Member States' constitutions and international legal obligations, such as the European Convention on Human Rights (ECHR); and the EU system based on the Charter, which comes into operation only in relation to actions by EU institutions, or when Member States implement EU law.

Aussi incombe-t-il au premier chef à ces institutions d’assurer le respect des droits fondamentaux, obligation juridique découlant du caractère contraignant de la Charte.
It is therefore the primary responsibility of the EU institutions to ensure respect for fundamental rights as a legal requirement based on the binding Charter.

Acknowledges that the responsibility to protect fundamental rights lies jointly with the European Commission and Member States; calls on the Commission to use its competences to the fullest extent, including facilitating the exchange of good practices among Member States; calls on Member States to fulfil their obligations under EU law and under the Council of Europe Recommendation on measures to combat discrimination on grounds of sexual orientation or gender identity;

Le présent règlement devrait s'appliquer à tous les aspects de la protection des libertés et droits fondamentaux à l'égard du traitement des données à caractère personnel qui ne sont pas soumis à des obligations spécifiques ayant le même objectif énoncées dans la directive 2002/58/CE du Parlement européen et du Conseil , y compris les obligations incombant au responsable du traitement et les droits des personnes physiques.
This Regulation should apply to all matters concerning the protection of fundamental rights and freedoms vis-à-vis the processing of personal data which are not subject to specific obligations with the same objective set out in Directive 2002/58/EC of the European Parliament and of the Council , including the obligations on the controller and the rights of natural persons.

4. La présente directive n'a pas pour effet de modifier l'obligation de respecter les droits fondamentaux et les principes juridiques inscrits à l'article 6 du traité sur l'Union européenne, y compris les droits de la défense des personnes faisant l'objet d'une procédure pénale, et il n'est porté atteinte à aucune des obligations qui incombent aux autorités judiciaires à cet égard.
4. This Directive shall not have the effect of modifying the obligation to respect the fundamental rights and legal principles as enshrined in Article 6 of the TEU, including the rights of defence of persons subject to criminal proceedings, and any obligations incumbent on judicial authorities in this respect shall remain unaffected.

Je ne suis pas d’accord avec la résolution lorsqu’elle dit que la responsabilité du respect du droit international et des droits fondamentaux incombe à tous les pays démocratiques et en particulier à l’Union européenne.
Moreover, I do not agree with the assertion made in the resolution that the responsibility for respect for international law and fundamental rights rests with all democratic countries, particularly the European Union.

17. attend des actions plus concrètes du commissaire compétent, conformément aux intentions déjà déclarées: en particulier, et avant toute chose, se félicite de l'engagement à mettre en place une étude d'impact sur les droits fondamentaux de toute nouvelle proposition législative; à surveiller le processus législatif pour faire en sorte que le texte final soit conforme à la Charte; à appliquer une politique de «tolérance zéro» en ce qui concerne les manquements à la Charte, à mener des enquêtes approfondies et à lancer des procédures d'infraction lorsque les États membres ne satisfont pas aux obligations qui leur incombent en matière de droits de l'homme dans le cadre de la mise en œuvre de la législation européenne, et garantir que les citoyens de l'Union européenne sont correctement informés de la nouvelle architecture des droits fondamentaux; demande qu'il soit donné suite à la communication de 2003 sur l'article 7 du traité sur l'Union européenne (COM(2003)0606) qui demandait de définir un moyen transparent et cohérent de réagir aux éventuelles violations des droits de l'homme et d'utiliser de façon pertinente cet article 7 au vu de la nouvelle architecture de l'Union dans le domaine des droits fondamentaux;

Expects concrete actions by the new Commissioner responsible, in line with already declared intentions: particularly and most importantly, welcomes the commitment to introduce a fundamental-rights impact assessment of all new legislative proposals; to oversee the legislative process to ensure that emerging final texts comply with the Charter; to apply a ‘zero tolerance’ policy on violations of the Charter, conducting in-depth investigations and initiating infringement procedures when Member States are in breach of their human rights obligations in implementing EU law; and to make sure EU citizens are properly informed on the new fundamental-rights architecture; calls for follow-up to the 2003 Communication on Article 7 of the Treaty on European Union (COM(2003)0606) to define a transparent and coherent way to address possible violations of human rights and make relevant use of Article 7 TEU on the basis of the new fundamental-rights architecture;

La présente décision-cadre ne saurait avoir pour effet de modifier l'obligation de respecter les droits fondamentaux et les principes juridiques fondamentaux tels qu'ils sont consacrés par l'article 6 du traité sur l'Union européenne et aucune obligation incombant à cet égard aux services répressifs n'est affectée.
7. This Framework Decision shall not have the effect of modifying the obligation to respect fundamental rights and fundamental legal principles as enshrined in Article 6 of the Treaty on European Union and any obligations incumbent on law enforcement authorities in this respect shall remain unaffected.
