Les dispositions relatives à la rémunération ne devraient pas porter préjudice au plein exercice des droits fondamentaux garantis par le traité sur l’Union européenne, le traité sur le fonctionnement de l’Union européenne et la Charte des droits fondamentaux de l’Union européenne, aux principes généraux du droit des contrats et du droit du travail au niveau national, à la législation applicable aux droits et à la participation des actionnaires et aux responsabilités générales des organes administratifs et de surveillance des sociétés concernées ni, le cas échéant, au droit des partenaires sociaux de conclure et d’appliquer des conventions collectives, conformément au droit et aux usages nationaux.
The provisions on remuneration should be without prejudice to the full exercise of fundamental rights guaranteed by the Treaty on European Union (TEU), the Treaty on the Functioning of the European Union (TFEU) and the Charter of Fundamental Rights of the European Union (the Charter), to general principles of national contract and labour law, applicable legislation regarding shareholders’ rights and involvement and the general responsibilities of the administrative and supervisory bodies of the companies concerned, as well as to the right, where applicable, of the social partners to conclude and enforce collective agreements, in accordance with national law and practice.

E. whereas a genuine culture of fundamental rights must be developed, promoted and reinforced in the institutions of the Union but also in Member States, especially in applying and implementing Union law, both internally and in relations with third countries; whereas the implementation of these values and principles must also be based on effective monitoring of respect for the fundamental rights guaranteed in the Charter, for example when legislative proposals are being drawn up; whereas other considerations may not take precedence over respecting and guaranteeing those fundamental rights, since this would risk discrediting the role and image of the European Union regarding human rights, particularly in its relations with third countries;

O. whereas the host of fundamental rights that are affected in the Internet world include, but are not limited to, respect for private life (including the right to permanently delete a personal digital footprint), data protection, freedom of expression, speech and association, freedom of the press, political expression and participation, non-discrimination, and education; whereas the content of such rights, including their field of application and their scope, the level of protection provided by such rights and the prohibitions on abuse of such rights should be governed by the rules on the protection of human and fundamental rights guaranteed by the Constitutions of the Member States, international human rights treaties, including the ECHR, general principles of Community law and the Charter of Fundamental Rights of the European Union, and/or by other relevant rules of national, international and Community law, in their respective fields of application,
