En coopération avec les États membres, la Commission et la haute représentante entendent: · œuvrer à une politique internationale de l'UE cohérente en matière de cyberespace afin d'approfondir la collaboration avec les principaux partenaires et organisations internationaux, d'intégrer les questions inhérentes au cyberespace à la PESC et d'améliorer la coordination de celles qui ont une dimension mondiale; · soutenir l'élaboration de règles de conduite et de mesures de confiance en matière de cybersécurité, faciliter le dialogue sur la façon d'appliquer le droit international existant dans le cyberespace et promouvoir la convention de Budapest pour lutter contre la cybercriminalité; · soutenir la défense et la protection des droits fondamentaux, y compris l'accès à l'information et la liberté d'expression, en s'attachant à: a) établir de nouvelles orientations publiques sur la liberté d'expression en ligne et hors ligne; b) contrôler l'exportation des produits et services qui pourraient être utilisés à des fins de censure ou de surveillance de masse en ligne; c) mettre au point des mesures et des outils permettant d'élargir l'accès à Internet, d'accroître son ouverture et sa résilience pour échapper à la censure ou la surveillance de masse par les technologies des communications; d) habiliter les parties prenantes à utiliser les technologies des communications pour promouvoir les droits fondamentaux; · s'employer, aux côtés des principaux partenaires et organisations internationaux, du secteur privé et de la société civile, à aider les pays tiers à se doter de moyens de portée mondiale afin d'améliorer l'accès à l'information et à un Internet ouvert, à prévenir et affronter les cybermenaces, y compris les événements accidentels, la cybercriminalité et le cyberterrorisme, et à renforcer la coordination entre les donateurs afin de canaliser les efforts dans ce sens; · recourir à différents dispositifs d'aide de l'UE pour la mise en place de moyens de cybersécuri ...
In cooperation with the Member States, the Commission and the High Representative will: · Work towards a coherent EU International cyberspace policy to increase engagement with key international partners and organisations, to mainstream cyber issues into CFSP, and to improve coordination of global cyber issues; · Support the development of norms of behaviour and confidence building measures in cybersecurity. Facilitate dialogues on how to apply existing international law in cyberspace and promote the Budapest Convention to address cybercrime; · Support the promotion and protection of fundamental rights, including access to information and freedom of expression, focusing on: a) developing new public guidelines on freedom of expression online and offline; b) monitoring the export of products or services that might be used for censorship or mass surveillance online; c) developing measures and tools to expand Internet access, openness and resilience to address censorship or mass surveillance by communication technology; d) empowering stakeholders to use communication technology to promote fundamental rights; · Engage with international partners and organisations, the private sector and civil society to support global capacity-building in third countries to improve access to information and to an open Internet, to prevent and counter cyber threats, including accidental events, cybercrime and cyber terrorism, and to develop donor coordination for steering capacity-building efforts; · Utilise different EU aid instruments for cybersecurity capacity building, including assisting the training of law enforcement, judicial and technical personnel to address cyber threats; as well as supporting the creation of relevant national policies, strategies and institutions in third countries; · Increase policy coordination and information sharing through the international Critical Information Infrastructure Protection networks such as the Meridian network, cooperation among NIS ...

At the same time – in view of the fact that, as underlined by the Court of Justice of the EU[24], the right to the protection of personal data is not an absolute right, but must be considered in relation to its function in society[25] and be balanced with other fundamental rights, in accordance with the principle of proportionality[26] – the Regulation will include explicit provisions that ensure the respect of other fundamental rights, such as freedom of expression and information, the right to defence, as well as of professional secrecy (such as for the legal profession), without prejudicing the status of churches under the laws of the Member States.

This Directive respects fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and in particular the right to the protection of human dignity, the prohibition of torture and inhuman or degrading treatment or punishment, the rights of the child, the right to liberty and security, the right to freedom of expression and information, the right to the protection of personal data, the right to an effective remedy and to a fair trial and the principles of legality and proportionality of criminal offences and penalties.

(139) In view of the fact that, as underlined by the Court of Justice of the European Union, the right to the protection of personal data is not an absolute right, but must be considered in relation to its function in society and be balanced with other fundamental rights, in accordance with the principle of proportionality, this Regulation respects all fundamental rights and observes the principles recognised in the Charter of Fundamental Rights of the European Union as enshrined in the Treaties, notably the right to respect for private and family life, home and communications, the right to the protection of personal data, the freedom of thought, conscience and religion, the freedom of expression and information, the freedom to conduct a business, the right to an effective remedy and to a fair trial as well as cultural, religious and linguistic diversity.

(37) considérant que le traitement de données à caractère personnel à des fins de journalisme ou d'expression artistique ou littéraire, notamment dans le domaine audiovisuel, doit bénéficier de dérogations ou de limitations de certaines dispositions de la présente directive dans la mesure où elles sont nécessaires à la conciliation des droits fondamentaux de la personne avec la liberté d'expression, et notamment la liberté de recevoir ou de communiquer des informations, telle que garantie notamment à l'article 10 de la convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales; qu'il incombe donc aux États membres, aux fins de la pondération entre les droits fondamentaux, de prévoir les dérogations et limitations nécessaires en ce qui concerne les mesures générales relatives à la légalité du traitement des données, les mesures relatives au transfert des données vers des pays tiers ainsi que les compétences des autorités de contrôle, sans qu'il y ait lieu toutefois de prévoir des dérogations aux mesures visant à garantir la sécurité du traitement; qu'il conviendrait également de conférer au moins à l'autorité de contrôle compétente en la matière certaines compétences a posteriori, consistant par exemple à publier périodiquement un rapport ou à saisir les autorités judiciaires;
(37) Whereas the processing of personal data for purposes of journalism or for purposes of literary of artistic expression, in particular in the audiovisual field, should qualify for exemption from the requirements of certain provisions of this Directive in so far as this is necessary to reconcile the fundamental rights of individuals with freedom of information and notably the right to receive and impart information, as guaranteed in particular in Article 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms; whereas Member States should therefore lay down exemptions and derogations necessary for the purpose of balance between fundamental rights as regards general measures on the legitimacy of data processing, measures on the transfer of data to third countries and the power of the supervisory authority; whereas this should not, however, lead Member States to lay down exemptions from the measures to ensure security of processing; whereas at least the supervisory authority responsible for this sector should also be provided with certain ex-post powers, e.g. to publish a regular report or to refer matters to the judicial authorities;
