Compte tenu des dossiers et des jugements précédents, le Médiateur a effectué une analyse approfondie de la plainte et il en a conclu qu’en effet, il existait des preuves de discrimination ainsi qu’une infraction à la Charte des droits fondamentaux. Il a donc recommandé que la Commission modifie le règlement en accord avec l’action déjà prise par le Parlement après le jugement rendu par le Tribunal de première instance.
Taking into account previous cases and rulings, the Ombudsman made a thorough analysis of the complaint and concluded that, indeed, there had been evidence of discrimination and an infringement of the Charter of Fundamental Rights; he therefore recommended that the Commission change the rule in line with the action already taken by Parliament following the ruling by the Court of First Instance.

En Allemagne, un catalogue exhaustif de droits fondamentaux existait déjà dans la constitution de Weimar mais son exhaustivité était telle qu'il s'est dégradé en un objectif inapplicable sur le plan juridique.
In Germany an extensive list of fundamental rights already existed in the Weimar constitution which, however, because it was so extensive, degenerated into a simple set of targets which could not be legally enforced.
