Points out that the Paris Principles on NHRIs should be used as a model for reforming the national institutions and the FRA, and calls on the Commission and the Council , together with the European Parliament, to revise, as a matter of urgency, the founding regulation of the FRA under the ordinary legislative procedure, so that the remit of the FRA is broadened to cover the full scope of Articles 2, 6 and 7 of the TEU and, in particular, the European Charter’s implementation by the EU institutions, agencies, offices and bodies, as well the activities of Member States; considers that the independence of the FRA should be strengthened, as well as its powers and competences; considers that the FRA Scientific Committee and the FRANET network should submit to the European Parliament and the national parliaments and publish annually a thematic and more focused report assessing the situation in the Member States, as was done until 2006 by the former Network of Experts on Fundamental Rights; calls on the FRA to fully respect Article 15 of the TFEU by making its proceedings open and by giving access to its documents via a publicly accessible register, as foreseen by Regulation (EC) No 1049/2001;

La présente directive respecte les droits fondamentaux et observe les principes reconnus par la Charte des droits fondamentaux de l'Union européenne, notamment la protection des données à caractère personnel (article 8), la liberté professionnelle et le droit de travailler (article 15), la liberté d'entreprise (article 16), le droit de négociation et d'actions collectives (article 28), les conditions de travail justes et équitables (article 31), le droit à un recours effectif et à accéder à un tribunal impartial (article 47), la présomption d'innocence et les droits de la défense (article 48) et le droit à ne pas être jugé deux fois pour une même infraction (non bis in idem) (article 50), et elle doit être appliquée conformément à ces droits et à ces principes.
This Directive respects the fundamental rights and observes the principles recognised in the Charter of Fundamental Rights of the European Union, notably protection of personal data (Article 8), the freedom to choose an occupation and right to engage in work (Article 15), the freedom to conduct a business (Article 16), the right to collective bargaining and action (Article 28), fair and just working conditions (Article 31), the right to an effective remedy and to a fair trial (Article 47), the presumption of innocence and right of defence (Article 48) and the right not to be tried twice for the same offence (ne bis in idem) (Article 50), and has to be implemented in accordance with those rights and principles.

This Directive respects fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and notably the right to liberty and security, the respect for private and family life, the freedom to choose an occupation and right to engage in work, the freedom to conduct a business, the right to property, the right to an effective remedy and to a fair trial, the presumption of innocence and right of defence, the principles of the legality and proportionality of criminal offences and penalties, as well as the right not to be tried or punished twice in criminal proceedings for the same criminal offence.

Calls on the EU institutions and the Member States to redouble their efforts aimed at properly informing and raising the awareness of the public, as fundamental rights can be protected more effectively if individuals themselves are aware of their rights and the mechanisms available to protect them; calls for active use of the experience of civic bodies and relevant NGOs and for the maintenance of an ongoing working relationship with all such bodies in implementing the new architecture of fundamental rights and in taking action on specific cases;

I condemn the existence of mechanisms attributing uniqueness, which create situations of privilege and of discrimination that breach fundamental rights themselves, specifically those enshrined in the Charter on Fundamental Rights, since these mechanisms impose conditions on or even run counter to the basic principles of social structures.
