déplore le peu de progrès accomplis dans l'application du règlement (CE) no 1049/2001 en ce qui concerne l'obligation faite aux institutions, agences et autres organes de tenir des registres complets des documents, comme le prévoient les articles 11 et 12 du règlement précité et, plus récemment, le traité de Lisbonne et la charte des droits fondamentaux; demande l'adoption d'une approche commune en matière de registres et demande aux institutions de l'Union d'établir des registres de documents si elles ne l'ont pas encore fait et de prendre des mesures d'applications afin d'harmoniser la classification et la présentation des documents entre les institutions; demande à nouveau, à cet égard, l'élaboration d'un point d'accès commun aux documents de l'Union par le truchement des portails des trois institutions, d'une part, et de procédures et de critères communs pour l'enregistrement, d'autre part, ainsi que l'attribution à chaque document d'un code interinstitutionnel qui permettrait, à terme, de créer un registre interinstitutionnel commun, notamment une base de données communes sur l'état d'avancement des dossiers législatifs.
Regrets that little progress has been made to implement Regulation (EC) No 1049/2001 as regards the obligation for the institutions, agencies and other bodies to keep complete registers of documents, as provided for in its Articles 11 and 12 and, ultimately, in the Lisbon Treaty and the Charter of Fundamental Rights; calls for a common approach on registers to be established, and calls on those EU institutions that have not yet established registers of documents to do so, and to implement measures to standardise the classification and presentation of the institutions’ documents; reiterates, in this regard, further to a common access point to EU documents through the three institutions’ portals, its call for common procedures and criteria for registration and the assignment of an interinstitutional code to each document so that, eventually, a common interinstitutional register, including a dedicated joint database on the state of play of legislative files, could be established.

21. souligne que le rôle de gardienne des traités de la Commission ne se limite pas à veiller à ce que la législation soit transposée par les États membres, mais couvre aussi l'application totale et correcte des actes législatifs, notamment afin de protéger les droits fondamentaux des citoyens; déplore la limitation de fait du champ d'application de la charte en raison d'une interprétation excessivement restrictive de son article 51, qui l'empêche de couvrir l'application effective du droit de l'Union; estime qu'il convient de revoir cette approche afin de répondre aux attentes des citoyens de l'Union au sujet de leurs droits fondamentaux; rappelle que les attentes des citoyens vont au-delà de l'interprétation stricte de la charte et que l'objectif devrait être de rendre ces droits aussi effectifs que possible; regrette par conséquent que la Commission invoque l'absence de compétence dans de nombreuses réponses à des pétitions dénonçant une possible violation des droits fondamentaux; demande, dans ce cadre, l'instauration d'un mécanisme de suivi, d'évaluation systématique et de formulation de recommandations afin d'encourager le respect global des valeurs fondamentales dans les États membres;
21. Stresses that the role of the Commission as the guardian of the Treaties is not limited to ensuring that legislation is transposed by the Member States, but also extends to the full and correct application of laws, in particular with a view to protecting citizens’ fundamental rights; regrets the effective limitation of the scope of application of the Charter due to an excessively restrictive interpretation of its Article 51, read as preventing it from covering the enforcement of EU law; is of the opinion that this approach should be revised to meet EU citizens’ expectations in relation to their fundamental rights; recalls that the expectations of citizens go beyond the strict interpretation of the Charter and that the objective should be to render those rights as effective as possible; regrets, therefore, that the Commission pleads lack of competence in numerous replies to petitions complaining of a possible breach of fundamental rights; in this framework, calls for the establishment of a mechanism for the monitoring, systematic evaluation and issuing of recommendations, to foster overall compliance with fundamental values in the Member States;

45. condamne les atteintes de plus en plus nombreuses aux droits fondamentaux des migrants, notamment ceux qui sont expulsés vers des pays tiers, comme le rapporteur spécial des Nations Unies pour les droits de l'Homme des migrants l'a indiqué dans son rapport spécial publié le 24 avril 2013 et comme le confirme le rapport de l'Agence européenne des droits fondamentaux ; souligne à cet égard la nécessité d'évaluer réellement la directive «Retour», les accords de réadmission ainsi que l'action de Frontex du point de vue du respect des droits fondamentaux; demande à la Commission de donner des suites concrètes à son rapport critique sur les accords et mesures de réadmission de l'Union avec des pays tiers, publié en 2011; condamne les politiques de certains États membres qui restreignent l'octroi de visas aux ressortissants de certains pays tiers;
45. Condemns the increasingly frequent violations of migrantsʼ fundamental rights, particularly where they are deported to non-EU countries as highlighted by the UN Special Rapporteur on the human rights of migrants in his special report published on 24 April 2013 and by the FRA report ; stresses, in this connection, the need for the Return Directive, the readmission agreements and the work of Frontex to be genuinely appraised in terms of their respect for fundamental rights; calls on the Commission to provide a tangible follow-up to its 2011 report criticising the EU’s readmission measures and agreements with non-EU countries; condemns the restrictive policies of Member States with regard to issuing visas to nationals of some specific non-EU countries;

rappelle que, dans un grand nombre de navires ne battant pas pavillon d'un État membre de l'Union qui font escale dans les ports européens, l'équipage est en grande majorité philippin et que bon nombre de ces marins travaillent dans des conditions extrêmement dures et inhumaines, et demande dès lors aux États membres de ne pas autoriser l'accueil, dans les ports européens, de ces navires dans lesquels les conditions de travail sont contraires aux droits des travailleurs et aux principes consacrés par la charte des droits fondamentaux de l'Union européenne; demande également que les navires ne battant pas pavillon d'un État membre de l'Union garantissent à leurs équipages les conditions de travail prévues par le droit international et les normes fixées par l'Organisation internationale du travail et l'Organisation maritime internationale.
Bearing in mind that the majority of the crew on many non-Community flagged vessels calling at European ports are Filipino, as well as the harsh and inhuman working conditions in which many of these seafarers live, calls on Member States not to allow these vessels to be received in European ports when the working conditions on board contravene the labour rights and principles enshrined in the Charter of Fundamental Rights of the European Union; urges, likewise, non-Community flagged vessels to guarantee their crews’ working conditions in accordance with international legislation and the rules laid down by the ILO and the IMO.

Points out that the Paris Principles on NHRIs should be used as a model for reforming the national institutions and the FRA, and calls on the Commission and the Council , together with the European Parliament, to revise, as a matter of urgency, the founding regulation of the FRA under the ordinary legislative procedure, so that the remit of the FRA is broadened to cover the full scope of Articles 2, 6 and 7 of the TEU and, in particular, the European Charter’s implementation by the EU institutions, agencies, offices and bodies, as well the activities of Member States; considers that the independence of the FRA should be strengthened, as well as its powers and competences; considers that the FRA Scientific Committee and the FRANET network should submit to the European Parliament and the national parliaments and publish annually a thematic and more focused report assessing the situation in the Member States, as was done until 2006 by the former Network of Experts on Fundamental Rights; calls on the FRA to fully respect Article 15 of the TFEU by making its proceedings open and by giving access to its documents via a publicly accessible register, as foreseen by Regulation (EC) No 1049/2001;
