Stresses the need for coherence and consistency across all policy areas as an essential condition for an effective and credible human rights strategy and considers it regrettable that there is no specific reference to these principles in the Strategic Framework; reminds the Commission of its repeated commitments, as set out in its 2001 communication and its 2010 Communication on an Action Plan Implementing the Stockholm Programme (COM(2010)0171 ), to take practical steps to ensure greater coherence and consistency between its external and internal policies; recalls that the full involvement of Parliament and greater coordination in this area were agreed in 2001; reminds the Member States and the EU institutions that respect for fundamental rights begins at home and must not be taken for granted, but continually assessed and improved, so that the EU can be heard as a credible voice on human rights in the world;

By means of an interim measure, order the European Union to compensate, on the basis of Article 340(2) of the Treaty on the Functioning of the European Union, all of the material damage suffered by all the applicants during the period from 1 January 2012 to the time at which the applicants began to exercise the functions of Croatian bailiffs in accordance with Article 36(1) and Annex VII(1) of the Act of Accession, legally binding on all 28 signatory States of the Treaty of Accession of the Republic of Croatia to the European Union, including the Commission since 9 December 2011, as a result of the European Commission’s failure to fulfil its monitoring obligation under Article 36(1) and (2) of the Act of Accession, intended to ensure that the Republic of Croatia would establish the profession of bailiff from 1 January 2012, a commitment undertaken during the negotiations on the accession of the Republic of Croatia to the European Union in the context of Chapter 23, ‘Justice and Fundamental Rights’, referred to in section 1 of Annex VII of the Act of Accession, ‘Specific commitments undertaken by the Republic of Croatia in the accession negotiations’, which states: ‘1. To continue to ensure effective implementation of its Judicial Reform Strategy and Action Plan’.

Upon invitation by the European Council, the Commission reiterates its intention to present without delay a proposal for a negotiating framework, which takes into account the need to solve the name issue at an early stage of accession negotiations, and will carry out the process of analytical examination of the EU acquis beginning with the chapters on the judiciary and fundamental rights, and justice, freedom and security.

Once the Commission has submitted a proposal, the legislative procedure in Parliament starts with an in-depth examination of respect for fundamental rights, the principles of subsidiarity and proportionality, and an estimate of the financial resources needed.

C’est pourquoi je ne puis que me féliciter du rapport de M. Voggenhuber, c’est à dire l’initiative de la Commission, dans la mesure où celle-ci attire notre attention à tous sur un aspect essentiel de la question, à savoir que le respect effectif des droits fondamentaux commence avec le respect de la Charte des droits fondamentaux par la Commission, quand celle-ci fait des propositions de loi. De la même façon, il faut organiser des contrôles stricts et réguliers du respect des droits de l’homme.
For this reason, I can only welcome Mr Voggenhuber’s report, that is, the initiative of the Commission, since it draws the attention of all of us to the key question that the effective respect of fundamental rights begins when respect for the Charter of Fundamental Rights features among the Commission’s legislative proposals, when regular and strict controls of human rights compliance have been developed, and when the Fundamental Rights Agency is able to work effectively.
