A. Whereas the European Union has set itself the aim of offering its citizens an area of freedom security and justice, and whereas, pursuant to Article 6 of the Treaty on European Union (TEU), it respects human rights and fundamental freedoms, thereby taking on positive obligations which it must meet in order to honour that commitment; whereas to be effective, the principle of mutual recognition must be premised upon mutual trust which can only be achieved if respect for the fundamental rights of suspects and accused persons and procedural rights in criminal proceedings are guaranteed throughout the Union; whereas mutual trust is enhanced through training, cooperation and dialogue between judicial authorities and legal practitioners, creating a genuine European judicial culture;

Actuellement, la durée des procédures paraît difficilement acceptable pour les justiciables, notamment au regard des exigences énoncées tant à l'article 47 de la charte des droits fondamentaux de l'Union européenne qu'à l'article 6 de la convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales.
At present, the duration of proceedings does not appear to be acceptable from the point of view of litigants, particularly in the light of the requirements set out in Article 47 of the Charter of Fundamental Rights of the European Union and in Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms.

Néanmoins, les juridictions ou autres autorités compétentes ne devraient pas pouvoir appliquer l'exception d'ordre public en vue d'écarter la loi d'un autre État membre ou refuser de reconnaître — ou, le cas échéant, d'accepter —, ou d'exécuter une décision rendue, un acte authentique ou une transaction judiciaire d'un autre État membre, lorsque ce refus serait contraire à la Charte des droits fondamentaux de l'Union européenne, en particulier à son article 21 qui interdit toute forme de discrimination.
However, the courts or other competent authorities should not be able to apply the public-policy exception in order to set aside the law of another State or to refuse to recognise or, as the case may be, accept or enforce a decision, an authentic instrument or a court settlement from another Member State when doing so would be contrary to the Charter of Fundamental Rights of the European Union, and in particular Article 21 thereof, which prohibits all forms of discrimination.

(25) Dans sa jurisprudence[33] sur l’action positive et la compatibilité de celle-ci avec le principe de non-discrimination fondée sur le sexe (également énoncé, désormais, à l’article 21 de la charte des droits fondamentaux de l’Union européenne), la Cour de justice de l’Union européenne a accepté que, dans certains cas, priorité puisse être accordée au sexe sous-représenté dans les procédures de sélection en matière d’emploi ou de promotion, à condition que le candidat du sexe sous-représenté possède une qualification égale à celle du concurrent de l’autre sexe quant à leur aptitude, à leur compétence et à leurs prestations professionnelles; que cette priorité ne soit pas automatique ni inconditionnelle mais qu’elle puisse être écartée si des motifs tenant à la personne d’un candidat de l’autre sexe font pencher la balance en sa faveur, et que la candidature de chacun fasse l’objet d’une appréciation objective qui tient compte de tous les critères relatifs à la personne des candidats.
(25) In its case-law[33] on positive action and the compatibility thereof with the principle of non-discrimination on ground of sex (now also laid down in Article 21 of the Charter of Fundamental Rights of the European Union), the Court of Justice of the European Union accepted that priority may in certain cases be given to the under-represented sex in selection for employment or promotion, provided that the candidate of the under-represented sex is equally qualified as the competitor of the other sex in terms of suitability, competence and professional performance, that the priority is not automatic and unconditional but may be overridden if reasons specific to an individual candidate of the other sex tilt the balance in that candidate's favour, and that the application of each candidate is subject of an objective assessment which takes account of all criteria specific to the individual candidates.
