The EIB's own rules and procedures shall include the necessary provisions on assessment of environmental and social impact of investment projects and of aspects related to human rights, fundamental freedoms and conflict prevention in line with the relevant Union principles and law, as well as legislation and environmental and social standards of the beneficiary countries and to ensure that predominantly investment projects that are economically, financially, environmentally and socially sustainable are supported under this Decision.

Restrictions concerning specific principles and the rights of information, access to and rectification or erasure of personal data, the right to data portability, the right to object, decisions based on profiling, as well as the communication of a personal data breach to a data subject and certain related obligations of the controllers may be imposed by Union or Member State law, as far as necessary and proportionate in a democratic society to safeguard public security, including the protection of human life especially in response to natural or manmade disasters, the prevention, investigation and prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security, or of breaches of ethics for regulated professions, other important objectives of general public interest of the Union or of a Member State, in particular an important economic or financial interest of the Union or of a Member State, the keeping of public registers kept for reasons of general public interest, further processing of archived personal data to provide specific information related to the political behaviour under former totalitarian state regimes or the protection of the data subject or the rights and freedoms of others, including social protection, public health and humanitarian purposes.

Highlights that the economic and financial crisis is a threat to human rights as a whole, including civil and political rights; underlines in particular that it has had detrimental effects on access to food, health care and education for the most vulnerable groups in society, in both urban and rural areas, and has resulted in dramatically increased poverty levels globally; recalls that governments have a duty to ensure respect for economic, social and cultural (ESC) rights and to provide protection against abuses by, for example, corporate and other private actors, through the implementation of the UN guiding principles on business and human rights, and to investigate financial crimes by these actors; likewise, points to the EU’s responsibility to propose partnership arrangements which contribute to the sustainable development of the host country and to employment, including minimum social standards;

Believes that the new Strategy on Human Rights, which focuses on economic, social and cultural rights as well as those codified in the Universal Declaration on Human Rights, should have an impact on budget support methods; advocates positive and weighted conditionality in this area, based on a dynamic approach – concerned with safeguarding the gains won after years of partnership – and taking place within the framework of a partnership grounded in a political dialogue concerning use of the various methods of implementation of EU financial support;
