Calls on the EU’s trade negotiations to promote obligations as well as rights for investors and businesses, as laid down in the ‘Heiligendamm Process’, initiated by the former German Presidency with the ILO, OECD and UN; points out that, in keeping with the new rules on responsible investment based on the relevant provisions of the Lisbon Treaty, the Sustainable Development chapter must incorporate all rules on investments laid down in FTAs; takes the view that all trade agreements must require compliance with the OECD Guidelines on Multinational Enterprises, the ILO Tripartite Declaration on Multinational Enterprises and Social Policy, the UN Global Compact and the Recommendations of the UN Special Representative on Business and Human Rights;

As regards the protection of workers, the Court points out that a prior declaration would enable the authorities to monitor compliance with German social welfare legislation during the deployment while taking account of the obligations by which that undertaking is already bound under the social welfare legislation applicable in the Member State of origin.

Je voudrais tout d’abord souligner que la présidence allemande et les futures présidences portugaise et slovène se sont engagées, dans leur programme commun de dix-huit mois, à assurer la continuité dans le développement d’un droit du travail moderne, social et durable dans l’UE. À cet égard, les mesures complémentaires faisant suite à la communication de la Commission sur la stratégie communautaire pour la santé et la sécurité au travail 2007-2012 auront un rôle à jouer, tout comme le livre vert, récemment présenté par la Commission, sur l’avenir du droit du travail.
I should first like to observe that the German Presidency and its future Portuguese and Slovenian successors have, in their shared eighteen-month programme, undertaken to ensure continuity in the development of modern, social and sustainable labour law across the EU, and the further measures following on from the Commission communication on the Community health and safety at work strategy for 2007-2012 will play a part in this, in precisely the same way as will the Green Paper recently presented by the Commission on the future of labour law.

It is, then, to give one example, contrary to the spirit of the Regulation for German employers to be required to grapple with an intolerable amount of red tape in order to remit to Poland social security contributions totalling 47.85% (20.64% from the employer, 27.27% from the employee) of the earnings of Polish seasonal workers, particularly when, under German law, no such contributions were payable in respect of their work prior to the accession of Poland to the EU.

Expects a stronger commitment from the EU in the Maghreb and Mashreq countries to supporting the process of economic and social modernisation, with a special emphasis on the social impact of those processes; considers that that commitment should have built into it a comprehensive social dialogue, including a dialogue of religions, so as to create a common region of stability and peace; recommends that troika contacts be stepped up with Algeria to foster a process of political reform and political dialogue encompassing all Algerians, in the interest of enhancing democracy, the rule of law and tolerance, and takes the view that the outcome of the ongoing negotiations on an association agreement must be made conditional on a peaceful solution to the internal crisis; insists, furthermore, that the European Union should cooperate actively in settling the conflict in Western Sahara in accordance with the United Nations resolutions, along the lines requested by the European Parliament in its resolution of 16 March 2000 and the Statement by the German presidency of the Council of June 1999;
