En voilà une nouvelle version, et lorsque le ministre Nicholson, notre ministre de la Justice, a témoigné devant le comité le 19 novembre dernier, il a parlé des nombreuses mesures de protection, notamment: (i) que le consentement préalable du procureur général du Canada, ou du procureur général ou solliciteur général de la province, sera requis avant qu'un agent de la paix ne puisse présenter une demande d'investigation; (ii) il devra exister des motifs raisonnables de croire qu'une infraction de terrorisme a été commise ou sera commise; (iii) le juge devra être convaincu que des efforts raisonnables ont été déployés pour obtenir par d'autres moyens les renseignements sur des infractions de terrorisme passées ou éventuelles; (iv) le projet de loi précise que l'article 707 du Code criminel, qui fixe la période maximale de détention d'un témoin, s'applique à une personne arrêtée sur la foi d'un mandat et détenue pour garantir sa comparution lors de l'investigation; (v) le témoin a le droit d'engager un avocat et de lui donner des instructions en tout état de cause; (vi) une personne peut refuser de répondre aux questions ou de remettre une chose dans la mesure où cela irait à l'encontre du droit canadien applicable en matière de privilèges ou de non-communication de renseignements protégés; (vii) les procureurs généraux fédéral et provinciaux seront tenus de présenter un rapport annuel sur le recours aux dispositions relatives à l'investigation; (viii) ce rapport annuel comprendra une exigence additionnelle prévoyant que le procureur général du Canada et le ministre de la Sécurité publique énonceront leur opinion, étayée par des motifs, quant à savoir si ces dispositions devraient rester en vigueur.
This is a new iteration of it, and when Minister Nicholson, our Minister of Justice, testified before this committee on November 19 of this year, he noted several and numerous safeguards, including: (i) that the prior consent of the Attorney General of Canada, or the attorney general or solicitor general of the province, would be needed before a peace officer could apply for an investigative hearing order; (ii) there would have to be reasonable grounds to believe that a terrorism offence has been or will be committed; (iii) the judge would have to be satisfied that reasonable attempts have been made to obtain the information by other means for both future and past terrorism offences; (iv) the bill clarifies that section 707 of the Criminal Code, which sets out the maximum period of detention for an arrested witness, applies to a person arrested with warrant and detained in order to ensure his or appearance at the investigative hearing; (v) the witness would have the right to retain and instruct counsel at any stage of the proceeding; (vi) a person could refuse to answer a question or produce anything that is protected by Canadian law relating to the non-disclosure of information or privilege; (vii) federal and provincial attorneys general would be required to report annually on any use of investigative hearings; (viii) this annual report would include an additional requirement that the Attorney General of Canada and the Minister of Public Safety provide their opinion, supported by reasons, on whether these provisions should remain in force.
