La décision-cadre 2009/315/JAI du Conseil concernant l’organisation et le contenu des échanges d’informations extraites du casier judiciaire entre les États membres (ci-après la «décision-cadre») vise à combler ces lacunes en prévoyant que pour les besoins de procédures pénales, à savoir lors de la phase préalable au procès pénal, lors du procès pénal lui-même ou de la phase d’exécution de la condamnation, toutes les juridictions et autorités de police des États membres ont accès aux informations sur les condamnations antérieures de tout citoyen de l’Union prononcées par une juridiction pénale siégeant dans l’UE. En imposant une série d’obligations à l’État membre de condamnation et à l’État membre de nationalité, cette décision-cadre garantit que chaque État membre fournit, à la demande d’un autre État membre, des informations exhaustives et détaillées concernant le casier judiciaire de ses ressortissants.
Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from the criminal record between Member States (the ‘Framework Decision’ or ‘FD’) aims to address these shortcomings by stipulating that information on any EU citizen’s previous convictions by any criminal court in the EU is available to all Member State courts and law-enforcement authorities for criminal proceedings in the pre-trial and trial stages and the execution of the conviction.By imposing a series of obligations on the convicting Member State and the Member State of nationality, the Framework Decision ensures that each Member State can provide exhaustive and complete information in relation to the criminal records of its nationals upon request by another Member State.
