Les instances compétentes de l'UE, y compris les groupes de travail concernés au sein du Conseil, devraient suivre la situation dans les domaines relevant de leur compétence, où le droit humanitaire international pourrait trouver à s'appliquer, en s'appuyant, au besoin, sur des avis concernant le droit humanitaire international et son applicabilité.
The responsible EU bodies, including appropriate Council Working Groups, should monitor situations within their areas of responsibility where IHL may be applicable, drawing on advice, as necessary, regarding IHL and its applicability.

Le Parquet européen est compétent à l’égard des infractions pénales portant atteinte aux intérêts financiers de l’Union qui sont prévues par la directive (UE) 2017/1371, mise en œuvre en droit interne, indépendamment de la question de savoir si le même comportement délictueux pourrait être classé comme un autre type d’infraction en droit interne.

The EPPO shall be competent in respect of the criminal offences affecting the financial interests of the Union that are provided for in Directive (EU) 2017/1371, as implemented by national law, irrespective of whether the same criminal conduct could be classified as another type of offence under national law.

Calls on the Foreign Affairs Council and the VP/HR to ensure that EU policies and actions related to IHL are developed in a coherent and effective way and that the implementation of IHL Guidelines falls primarily within the remit of the Council Working Group on Public International Law, chaired by the Council Presidency; emphasises, in this context, that the EU Guidelines commit ‘the appropriate Council working groups’ to monitoring situations where IHL may apply and, in such cases, to recommending action to promote compliance with IHL; calls for the EU and the Member States to provide more detailed reporting on the implementation of the Guidelines in specific conflict situations, in particular in the EU Annual Report on Human Rights and Democracy.

Calls for enhanced institutional space for the international community to address common concerns relating to IHL implementation; welcomes the pledge of the EU and its Member States to the ICRC to strongly support the establishment of an effective mechanism on strengthening compliance with IHL, but calls on the VP/HR to report to Parliament on her objectives and strategy in terms of realising this pledge in the forthcoming intergovernmental process to find ways to enhance the implementation of IHL as agreed at the 32nd International Conference of the Red Cross and Red Crescent in December 2015, which could strengthen the governance system of IHL.

whereas the Foreign Affairs Council, when adopting the EU Guidelines on promoting compliance with international humanitarian law, emphasised the importance of dealing effectively with the legacy of serious violations by supporting appropriate accountability mechanisms, and underlined the key role which the International Criminal Court (ICC) can play in cases where the state or states in question are unable or unwilling to exercise their jurisdiction; whereas the EU Guidelines commit the ‘appropriate Council working groups’ to monitoring situations where IHL may apply and, in such cases, to recommending action to promote compliance with IHL (paragraph 15(a)).

2. Lorsqu’une autorité compétente estime qu’un organisme de gestion collective établi dans un autre État membre mais exerçant ses activités sur son territoire pourrait ne pas respecter les dispositions du droit interne de l’État membre dans lequel ledit organisme de gestion collective est établi qui ont été adoptées conformément aux exigences prévues par la présente directive, elle peut transmettre toutes les informations pertinentes à l’autorité compétente de l’État membre dans lequel ledit organisme de gestion collective est établi, en les accompagnant, le cas échéant, d’une demande adressée à cette autorité visant à ce qu’elle prenne les mesures appropriées de son ressort.
2. Where a competent authority considers that a collective management organisation established in another Member State but acting within its territory may not be complying with the provisions of the national law of the Member State in which that collective management organisation is established which have been adopted pursuant to the requirements laid down in this Directive, it may transmit all relevant information to the competent authority of the Member State in which the collective management organisation is established, accompanied where appropriate by a request to that authority that it take appropriate action within its competence.

Believes that, in line with its obligations under international law, Turkey should pass legislation introducing, as an alternative to military service, civil or social service that is not punitive in length and is based on free choice; asks the Government to ensure full compliance with the judgment of the European Court of Human Rights in the case of Ülke v. Turkey, amending legislation to bring to an end the prosecution of conscientious objectors for their refusal to perform military service; asks the Government to investigate allegations of ill-treatment of conscientious objectors in military custody and to take steps to prevent such abuse in the future;

b) la recommandation pourrait inciter les États membres à intégrer l'instrument de droit européen des contrats à titre de régime facultatif, offrant aux contractants une solution de substitution au droit interne.
