3. rappelle que les produits de contrefaçon constituent une menace pour les intérêts et la sécurité des consommateurs et, dans certains cas, pour la santé publique et l'environnement; demande à la Commission, au Conseil et aux États membres de ne pas étendre la définition de la notion de "contrefaçon" au-delà de l'acception de violation délibérée de marque déposée pouvant porter atteinte aux intérêts et à la sécurité des consommateurs, à la santé publique et à l'environnement, et met en garde contre l'élargissement parallèle du champ d'application du droit pénal; rappelle que d'autres violations du droit de la propriété intellectuelle, telles que les atteintes aux droits d'auteur à des fins non commerciales et les contrefaçons de brevets, doivent continuer d'être régies par le droit civil; enfin, souligne que la lutte contre la contrefaçon et les atteintes à la propriété intellectuelle ne doit pas influer sur le commerce légitime de médicaments génériques;

Recalls that counterfeit products constitute a threat to consumers’ interests and safety, and in some cases to public health and the environment; calls upon the Commission, the Council and the Member States to refrain from expanding the definition of the notion of ‘counterfeiting’ beyond the scope of deliberate trademark violations which potentially damage consumers’ interests and safety, public health and the environment, and warns against the parallel expansion of the scope of criminal law; recalls that other IPR violations such as copyright infringements on a non-commercial scale and patent infringements should remain governed by civil law; lastly, points out that the fight against counterfeiting and intellectual property infringements must not affect legitimate trade in generic medicines;

5. invite le gouvernement iranien à suspendre l'exécution d'Ebrahim Hamidi, âgé de dix-huit ans et accusé de sodomie, et demande à la République islamique d'Iran de mettre enfin un terme à la peine de mort pour les crimes commis avant l'âge de dix-huit ans et de modifier sa législation afin de l'aligner sur les conventions internationales en matière de droits de l'homme que l'Iran a ratifiées, y compris la Convention relative aux droits de l'enfant et le Pacte international relatif aux droits civils et politiques;
5. Calls on the Government of Iran to halt the execution of Ebrahim Hamidi, an 18-year-old charged with sodomy, and calls on the Islamic Republic of Iran finally to abolish the death penalty for crimes committed before the age of 18 and amend its legislation to bring it into line with the international human rights conventions that Iran has ratified, including the Convention on the Rights of the Child and the ICCPR;

se félicite vivement de l'intention de la Commission d'insérer dans le programme de Stockholm des mesures visant à régler les problèmes auxquels les citoyens de l'Union sont confrontés durant leur existence dans l'Union; demande à la Commission de proposer, dans ce cadre, des mesures appropriées, notamment dans le domaine du droit civil, pour mettre enfin en œuvre le principe de l'égalité de traitement non seulement pour les marchandises, les capitaux et les services, mais aussi pour les personnes, sans les discriminations énumérées à l'article 13 du traité CE, car la situation actuelle constitue un obstacle à la libre circulation et est contraire aux valeurs européennes communes d'égalité et de non-discrimination;
Warmly welcomes the Commission's intention to insert measures in the Stockholm Programme aimed at addressing the problems faced by Union citizens during their life cycle in the EU; asks the Commission to propose, within this framework, appropriate measures, including in the field of civil law, to finally implement the principle of equal treatment not only in relation to goods, capitals and services, but also in relation to persons without discrimination as listed under Article 13 of the EC Treaty, as the current situation constitutes a barrier to free movement and is contrary to the common European values of equality and non-discrimination;

We must take the UN concept of human rights as our basis, and this comprises three central categories: firstly, what might be termed the negative rights to freedom, i.e. the right of each person to enjoy freedom from unjustified state coercion and other violence. Secondly, the positive rights: these guarantee the participation of the individual in political and social decision-making processes. And thirdly, social rights and the right to development which are invoked particularly by third world countries: they insist that civil and political rights also include the conditions that are necessary in order to exercise these rights.
