Au titre du septième moyen, les requérantes soutiennent que le Tribunal a commis une erreur de droit, au point 134 de son arrêt, en jugeant que l’article 23, par. 2, point d), du règlement no 267/2012 (le critère litigieux) est conforme aux principes de l’État de droit et plus généralement au droit de l’Union européenne car il ne serait «pas arbitraire, ni discrétionnaire» et, au point 140 de son arrêt, que «le critère litigieux limite le pouvoir d’appréciation du Conseil, en instaurant des critères objectifs, et garantit le degré de prévisibilité requis par le droit de l’Union».À cet égard, les requérantes soutiennent que le Tribunal a commis une erreur de droit en interprétant le critère litigieux en référence à l’arrêt du 13 mars 2012 Melli Bank/Conseil (C-380/09 P).
By their seventh ground of appeal, the appellants submit that the General Court erred in law in paragraph 134 of its judgment when it ruled that Article 23(2)(d) of Regulation No 267/2012 (the criterion at issue) is compatible with the principles of the rule of law and more generally with EU law, since it is ‘neither arbitrary nor discretionary’, and, in paragraph 140 of its judgment, that ‘the criterion at issue limits the Council’s discretion, by establishing objective criteria, and guarantees the degree of foreseeability required by EU law’. In that regard, the appellants submit that the General Court erred in law by interpreting the criterion at issue by reference to the judgment of 13 March 2012 in Melli Bank v Council (C-380/09 P).

Au titre du sixième moyen, la requérante soutient que le Tribunal a commis une erreur de droit au point 115 de son arrêt en jugeant que le critère posé à l’article 23, paragraphe 2, point d), du règlement (UE) no 267/2012 (le critère litigieux) est conforme aux principes de l’Etat de droit et plus généralement au droit de l’Union européenne car il ne serait «pas arbitraire, ni discrétionnaire» et, au point 123 de son arrêt que «le critère litigieux limite le pouvoir d’appréciation du Conseil, en instaurant des critères objectifs, et garantit le degré de prévisibilité requis par le droit de l’Union».
As the sixth ground of appeal, the appellant claims that the General Court erred in law in paragraph 115 of its judgment by holding that the criterion set out in Article 23(2)(d) of Regulation (EU) No 267/2012 (the contested criterion) is compatible with the principles of the rule of law and more generally with EU law since it is ‘neither arbitrary nor discretionary’ and, in paragraph 123 of its judgment that ‘the contested criterion limits the Council’s power of assessment, by providing for objective criteria, and ensures the level of foreseeability required by EU law’.

49 D’autre part, le Tribunal a jugé à bon droit, au point 56 du même arrêt, que les enregistrements d’ores et déjà effectués dans des États membres ne constituent que des éléments qui, sans être déterminants, peuvent seulement être pris en considération aux fins de l’enregistrement d’une marque communautaire (voir, en ce sens, à propos de l’enregistrement de marques nationales dans divers États membres en application de la directive 89/104, arrêt précité, Henkel, points 62 et 63).
Secondly, the Court of First Instance was correct in holding, in paragraph 56 of the judgment under appeal, that registrations already made in Member States are only factors which may merely be taken into consideration, without being given decisive weight, for the purposes of registering a Community trade mark (see, to that effect, with regard to registration of national trade marks in various Member States by application of Directive 89/104, Henkel, paragraphs 62 and 63).

En l’espèce, le Tribunal a considéré à bon droit, au point 64 des arrêts attaqués, qu’il n’était pas nécessaire de trancher la question de la date pertinente pour apprécier le caractère distinctif des marques au sens de ladite disposition, dès lors qu’il avait jugé que les marques dont l’enregistrement est demandé ne permettent pas de distinguer l’origine des produits en cause et que cette conclusion ne saurait être infirmée par le nombre plus ou moins grand de tablettes similaires déjà présentes sur le marché.
In this case, the Court of First Instance was correct in finding, in paragraph 64 of the judgments under appeal, that it was not necessary to decide which was the relevant date for the assessment of whether the trade marks had distinctive character for the purposes of that provision, since it had found that the marks for which registration was sought were not capable of identifying the origin of the products concerned and that that finding was not affected by how many similar tablets were already on the market.

Toutefois, ainsi que le Tribunal l’a relevé à bon droit au point 47 des arrêts attaqués, l’aptitude générale d’un signe à constituer une marque au sens de l’article 4 du règlement n° 40/94 n’implique cependant pas que ce signe possède nécessairement un caractère distinctif, au sens de l’article 7, paragraphe 1, sous b), dudit règlement, par rapport à un produit ou à un service déterminé.
However, as the Court of First Instance rightly pointed out in paragraph 47 of the judgments under appeal, the fact that a sign is, in general, capable of constituting a trade mark within the meaning of Article 4 of Regulation No 40/94 does not mean that the sign necessarily has distinctive character for the purposes of Article 7(1)(b) of the regulation in relation to a specific product or service.

2.2.
