IN-CONTEXT TRANSLATIONS

Une attention particulière sera accordée à la possibilité: 1) de simplifier et d’accélérer la procédure d’enregistrement, compte tenu des exigences du monde électronique; 2) d’accroître la sécurité juridique, par exemple en redéfinissant ce qui peut constituer une marque; 3) de préciser la portée des droits que confère la marque, notamment dans le cas des biens qui peuvent changer de statut sur le territoire douanier de l’UE; 4) de créer le cadre d’une coopération renforcée entre l’Office de l’harmonisation dans le marché intérieur (OHMI) à Alicante et les offices nationaux des marques, dans l’objectif d’harmoniser les pratiques administratives et de développer des outils communs, et notamment des outils offrant des possibilités beaucoup plus étendues de recherche d’antériorité et permettant de surveiller le registre aux fins de la détection des enregistrements en infraction; 5) de rendre la directive et le règlement plus cohérents, notamment en alignant davantage les motifs légaux de refuser l’enregistrement au niveau européen, et 6) d’aligner les motifs de refus et de coexistence en vertu tant de la directive que du règlement sur les règles relatives aux indications géographiques.
Particular focus will be on possibilities of: (1) simplifying and speeding up the registration procedure, taking into account the requirements of the electronic age; (2) increasing legal certainty, such as by redefining what may constitute a trade mark; (3) clarifying the scope of trade mark rights inter alia as regards goods in various situations throughout the EU customs territory; (4) providing a framework for increased cooperation between the Office for Harmonisation in the Internal Market (OHIM) at Alicante and national trade mark offices with the aim of harmonising administrative practice and developing common tools, such as those which offer far greater options for conducting priority searches, and watching the registry for infringing registrations; and (5) making the Directive more coherent with the Regulation, in particular, by further aligning the legal grounds of refusal for registration at European level, and (6) aligning the grounds for refusal and for coexistence under both the Directive and the Regulation to rules on geographical indications.

This report sets out the stage reached on five proposals - four Regulations and a draft Convention - the aim of which is to improve Community anti-fraud legislation; these proposals were submitted by the Commission as part of its work programme for 1994 and concern: - the protection of the Communities' financial interests; - a draft Convention for the protection of the Communities' financial interests covering the area of criminal sanctions; a progress report on the subject from the JHA Council is to be submitted to the European Council; - measures to be taken in dealing with certain beneficiaries of operations financed by the Guarantee Section of the EAGGF; - the amendment of Council Regulation No 4045/89 on scrutiny by Member States of transactions forming part of the system of financing by the EAGGF, Guarantee Section; - mutual assistance between the administrative authorities of the Member States and cooperation between the latter and the Commission to ensure the correct application of the law on customs and agricultural matters, and the repeal of Regulation No 1468/81; the Council recorded policy agreement on this draft without debate.
