2 bis. Les personnes interceptées ou secourues dont les unités participantes estiment qu'elles ne nécessitent pas de protection internationale, ou qui ne la réclament pas, peuvent être renvoyées dans leur pays d'origine ou dans tout autre pays où elles ont leur résidence habituelle ou dont elles ont la nationalité.

L'Article 3 de ce règlement stipule que: "les mesures prises aux fins d'une opération en mer sont exécutées de façon à garantir en toutes circonstances, la sécurité des personnes interceptées ou secourues, celle des unités participantes ou celle de tiers".
Article 3 of this Regulation further specifies that: "measures taken for the purpose of a sea operation shall be conducted in a way that, in all instances, ensures the safety of the persons intercepted or rescued, the safety of the participating units or that of third parties".

S'il s'avère impossible de faire en sorte que l'unité participante soit déchargée de son obligation visée à l'article 9, paragraphe 1, dans les meilleurs délais possibles, compte tenu de la sécurité des personnes secourues et de celle de l'unité participante elle-même, elle est autorisée à débarquer les personnes secourues dans l'État membre d'accueil.
If it is not possible to arrange for the participating unit to be released of its obligation referred to in Article 9(1) as soon as reasonably practicable, taking into account the safety of the rescued persons and that of the participating unit itself, it shall be authorised to disembark the rescued persons in the host Member State.

If evidence confirming that suspicion is found, the participating unit shall inform the host Member State which may take, directly or with the assistance of the Member State to whom the participating unit belongs, further appropriate measures as laid down in paragraphs 1 and 2 in accordance with national and international law.

7. Lorsqu'il existe des motifs raisonnables de soupçonner qu'un navire , bien qu'il batte pavillon étranger ou refuse d'arborer son pavillon, a en réalité la même nationalité qu'une unité participante, cette unité participante vérifie les titres autorisant le navire à battre son pavillon. 7. Where, though flying a foreign flag or refusing to show its flag, there are reasonable grounds to suspect that the vessel is, in reality, of the same nationality as a participating unit, that participating unit shall verify the vessel ’s right to fly its flag. To that end, it may approach the suspect vessel .
