Il incombe donc au tribunal polonais de décider si les évènements qui se sont déroulés le 17 septembre 1997 remplissent les critères de l'infraction visée à l'article 196 du code pénal polonais (il va de soi que le tribunal devrait également d'abord déterminer si le délai de prescription du délit a déjà expiré).
It is then a matter for the Polish court to decide whether the events that took place on 17 September 1997 fulfil the criteria of the crime as provided for in Art. 196 of the Polish Penal Code (the court would of course also have to consider in the first place whether the period of limitation for the offence had already expired).

The proposal for the establishment of a Community Patent Court is built on this approach. Consequently, the Community Patent Court should have its seat at the Court of First Instance without any of the possibilities that had been under discussion in the Council allowing for the establishment of permanent regional divisions of the Community Patent Court in Member States.

The Community Patent Court would thus have jurisdiction for the subject matter laid down in Article 1 of the Commission proposal for such a Council Decision, namely for disputes relating to the infringement or the validity of a Community patent and a Community supplementary protection certificate, the use of the invention after the publication of the Community patent application, the right based on prior use of the invention, interim and evidence-protection measures in the subject matters conferred, damages and compensation incurred in the situations referred to above and orders of a penalty payment in case of non-compliance with a decision or order constituting an obligation to act or to abstain from an act.

Les objections de l'Honorable parlementaire à propos de la remise de M. Milosevic au Tribunal pénal international de La Haye sont donc en contradiction avec les positions prises par le Conseil qui rappelle à l'Honorable Parlementaire que le Tribunal pénal international est une institution créée par le Conseil de Sécurité des Nations unies et à laquelle tous les pays membres des Nations unies, dont la République fédérale de Yougoslavie, sont tenus de coopérer en vertu de la résolution 827 du 25 mai 1993.
The Honourable Member’s objections to the handing over of Mr Milosevic to the International Criminal Tribunal in The Hague therefore go against the positions taken up by the Council, and the latter reminds the honourable Member that the International Criminal Tribunal is a body set up by the Security Council of the United Nations, and a body with which all the member countries of the United Nations, including the Federal Republic of Yugoslavia, are obliged to cooperate under Resolution 827 of 25 May 1993.

These reasons do, however, justify such a reform, particularly two or three of them, which I shall now mention. The first is the imbalance between the increasing volume of cases, the technical and human capacity of the courts in Luxembourg and the strict obligation to adhere to multilingual proceedings, which is the natural consequence of respect for each country’s language and legal traditions. The last reason is that this court, the Court of First Instance, is the only instance to which individuals and companies have recourse on economic disputes with regard to decisions by the bodies which affect them.
