(5) Pour l’application du présent article, « bien exclu » d’un contribuable s’entend d’un bien qu’il a acquis, ou qu’a acquis une personne avec laquelle il a un lien de dépendance, dans des circonstances où il est raisonnable de conclure que l’acquisition du bien a trait à un arrangement, un mécanisme, un plan ou un régime dont une autre personne ou une société de personnes fait la promotion et aux termes duquel il est raisonnable de conclure que le bien fera l’objet d’un don auquel s’appliquent le paragraphe 110.1(1) ou les définitions de « total des dons de bienfaisance » , « total des dons de biens culturels » ou « total des dons de biens écosensibles » au paragraphe 118.1(1).
(5) For the purpose of this section, “excluded property” of a taxpayer means property acquired by the taxpayer, or by a person with whom the taxpayer does not deal at arm’s length, in circumstances in which it is reasonable to conclude that the acquisition of the property relates to an arrangement, plan or scheme that is promoted by another person or partnership and under which it is reasonable to conclude that the property will be the subject of a gift to which subsection 110.1(1), or the definition “total charitable gifts” , “total cultural gifts” or “total ecological gifts” in subsection 118.1(1), applies.

(2.1) Pour déterminer le total des dons de bienfaisance, le total des dons à l’État, le total des dons de biens culturels et le total des dons de biens écosensibles d’un particulier pour une année d’imposition, aucun montant relatif à un don visé à la définition de l’une de ces expressions et fait au cours d’une année d’imposition donnée n’est considéré comme ayant été inclus dans le calcul d’un montant déduit en application du présent article dans le calcul de l’impôt payable par le particulier en vertu de la présente partie pour une année d’imposition tant que les montants relatifs à ces dons faits au cours des années d’imposition précédant l’année donnée qui peuvent être ainsi considérés ne sont pas ainsi considérés.
(2.1) For the purposes of determining the total charitable gifts, total Crown gifts, total cultural gifts and total ecological gifts of an individual for a taxation year, no amount in respect of a gift described in any of the definitions of those expressions and made in a particular taxation year shall be considered to have been included in determining an amount that was deducted under this section in computing the individual’s tax payable under this Part for a taxation year until amounts in respect of such gifts made in taxation years preceding the particular year that can be so considered are so considered.

(2) Where a taxpayer has disposed of part of a personal-use property (other than a part of an excluded property disposed of in circumstances to which subsection 110.1(1), or the definition “total charitable gifts” , “total cultural gifts” or “total ecological gifts” in subsection 118.1(1), applies) owned by the taxpayer and has retained another part of the property, for the purposes of this subdivision

8. Denounces in the strongest terms the destruction of religious and cultural sites and artefacts by the so-called ‘ISIS/Daesh’, which constitutes an attack against the cultural heritage of all inhabitants of Syria and Iraq and of humanity at large; calls on all states to step up their criminal investigations and judicial cooperation with a view to identifying all groups responsible for illicit trafficking in cultural goods and for damaging or destroying cultural heritage that belongs to all of humanity in Syria, Iraq and the broader Middle East and North African regions;

30. rappelle que l'Union a ratifié la convention de l'Unesco de 2005 sur la protection et la promotion de la diversité des expressions culturelles et demande aux États membres qui ne l'ont pas encore fait de ratifier la convention de l'Unesco de 1970 concernant les mesures à prendre pour interdire et empêcher l'importation, l'exportation et le transfert de propriété illicites de biens culturels, la convention de 1995 d'Unidroit sur les biens culturels volés ou illicitement exportés, qui constituent des instruments essentiels pour le renforcement de la protection du patrimoine culturel mondial et de la diversité culturelle, ainsi que la convention pour la protection des biens culturels en cas de conflit armé, signée en 1954, et ses deux protocoles, à savoir la convention de l'Unesco sur la protection du patrimoine culturel subaquatique, signée en 2001 ainsi que la convention de l'Unesco pour la sauvegarde du patrimoine culturel immatériel, signée en 2003; demande l'harmonisation de la législation et un accord international sur le patrimoine culturel et sur le trafic illicite;

Recalls that the EU has ratified the 2005 UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions and calls on the Member States who have not already done so to ratify the 1970 Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, and the 1950 UNIDROIT Convention on Stolen and Illegally Exported Cultural Objects, which represent important tools for strengthening the protection of global cultural heritage and cultural diversity, as well as the 1954 Convention for the Protection of Cultural Property in the Event of Armed Conflict and its two protocols, the 2001 UNESCO Convention on the Protection of the Underwater Cultural Heritage and the 2003 UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage; calls for the harmonisation of legislation and an international agreement on cultural heritage and illicit trafficking;

D. faisant valoir que de tels actes de destructions de sites et de biens culturels et historiques ne sont pas un phénomène récent et ne se limitent pas à l'Iraq et à la Syrie et que, selon l'Unesco "le patrimoine culturel est une composante importante de l'identité culturelle des communautés, groupes et individus, et de la cohésion sociale, de sorte que sa destruction intentionnelle peut avoir des conséquences préjudiciables sur la dignité humaine et les droits de l'homme"; soulignant que, comme l'a notamment déclaré l'Unesco, le produit du pillage de sites culturels et religieux et du trafic d'objets culturels et religieux en Iraq et en Syrie par le régime de Bachar el-Assad, l'Armée syrienne libre, l'EIIL/Daech ou d'autres groupes participant au conflit est utilisé pour financer le conflit et les activités terroristes, si bien que les objets d'art et les biens culturels deviennent des "armes de guerre";
D. emphasising that such acts of destruction of cultural and historical sites and objects are not new, and are not confined to Iraq and Syria, and that, according to UNESCO, ‘Cultural heritage is an important component of the cultural identity of communities, groups and individuals, and of social cohesion, so that its intentional destruction may have adverse consequences on human dignity and human rights’; stressing that, as stated by UNESCO amongst others, the products of looting and smuggling of cultural and religious sites and objects in Iraq and Syria by Bashar al-Assad’s regime, the Free Syrian Army (FSA) and the ISIS/Da’esh and other groups involved in the conflict are being used to help fund conflict and terrorist activities, with the result that artistic and cultural goods are becoming ‘war weapons’;

(4) La directive 93/7/CEE a mis en place un système permettant aux États membres d'obtenir la restitution, sur leur territoire, des biens culturels classés "trésors nationaux" au sens de l'article 36 du traité appartenant à des catégories communes de biens culturels visées dans son annexe et qui ont quitté leur territoire en violation des mesures nationales susmentionnées ou du règlement (CE) no 116/2009 du Conseil, du 18 décembre 2008, concernant l'exportation de biens culturels, et des objets culturels classés "trésors nationaux" qui forment partie intégrante des collections publiques ou des inventaires des institutions ecclésiastiques, mais qui n'entrent pas dans ces catégories communes;
(4) Directive 93/7/EEC introduced arrangements enabling Member States to secure the return to their territory of cultural objects which are classified as national treasures within the meaning of Article 36 of the Treaty, fall under the common categories of cultural object referred to in the Treaty’s Annex and have been removed from their territory in breach of the above-mentioned national measures or of Council Regulation (EC) No 116/2009 of 18 December 2008 on the export of cultural goods; and cultural objects classified as national treasures and forming an integral part of public collections or inventories of ecclesiastical institutions but which do not fall within these common categories.

(4) La directive 93/7/CEE a mis en place un système permettant aux États membres d'obtenir la restitution, sur leur territoire, des biens culturels classés "trésors nationaux" au sens de l'article 36 du traité appartenant à des catégories communes de biens culturels visées dans son annexe et qui ont quitté leur territoire en violation des mesures nationales susmentionnées ou du règlement (CE) n°°116/2009 du Conseil, du 18 décembre 2008, des objets culturels classés "trésors nationaux" qui forment partie intégrante des collections publiques ou des inventaires des institutions ecclésiastiques, mais qui n'entrent pas dans ces catégories communes, et des biens culturels provenant de fouilles illégales.

The formula is based on the individual's total gifts for the taxation year, meaning the total of the lesser of the individual's total charitable gifts for the year and generally 50% of the individual's income for the year in 1996 and later years up from 20% in 1992 to 1995; the individual's total crown gifts for the year; the individual's total cultural gifts for the year; and the individual's total ecological gifts for the year.
