Eu égard à des considérations liées tant à la nature purement technique des agences, que, plus généralement, aux principes de l'ordre juridique communautaire, le Livre blanc sur la gouvernance européenne a énuméré des limites ultérieures pour ce qui concerne le champ d'intervention des agences décisionnelles. In view of considerations in connection with both the purely technical nature of the agencies and, more generally, the principles on which the Community legal order is based, the White Paper on European Governance placed further restrictions on the decision-making agencies' scope for action, authorising them to intervene only in areas where a single public interest predominates and in areas where the agencies are not called upon to arbitrate on conflicting public interests, exercise any powers of political appraisal or conduct any complex economic assessments.

Je soutiens certains amendements proposés par ma collègue Mme Kauppi: les amendements 107 et 108, qui définissent clairement le terme "domaine technique", les amendements 112, 114 et 117 qui précisent que les programmes informatiques ne constituent pas en tant que tels des inventions brevetables, l’amendement 116 sur les limites de brevetabilité et les compromis de M. Wuermeling, dans lesquels il est fait référence au cadre juridique actuel de la base de données de l’Office européen des brevets et stipulent clairement que les inventions triviales et les méthodes destinées aux activités économiques ne sont pas brevetables.
I support some of the amendments proposed by my colleague Mrs Kauppi: Amendments Nos 107 and 108, which clearly define the term ‘field of technology’, Amendments Nos 112, 114 and 117, which make it clear that computer programs do not, in themselves, constitute patentable inventions, Amendment No 116 on the limits of patentability, and Mr Wuermeling’s compromises in which reference is made to the current EPAT legal framework and there is a clarification to the effect that trivial inventions and business methods are not patentable.

En soulignant le fait que, pour être brevetable, une invention mise en œuvre par ordinateur, bien qu'appartenant déjà à un domaine technique, doit en outre apporter une contribution technique à l'état de la technique, et en attirant l'attention sur l'approche problème-solution utilisée par les examinateurs de l'Office européen des brevets pour évaluer l'activité inventive, le but poursuivi est d'éviter que des méthodes relevant d'une activité inventive mais non techniques (telles que des méthodes destinées à l'exercice d'activités économiques) puissent être considérées comme apportant une contribution technique et donc comme brevetables, uniquement parce qu'elles sont mises en oeuvre sur un ordinateur.
By stressing the fact that a patentable computer-implemented invention, albeit belonging to a field of technology, must make a technical contribution to the state of the art and by drawing attention to the problem and solution approach used by the patent examiners at the European Patent Office in assessing inventive step, it is intended to avoid allowing inventive but non-technical methods (including business methods) to be regarded as making a technical contribution and hence as patentable merely because they are implemented on a computer.
