Au cas où le Tribunal viendrait à considérer, en dépit des arguments issus du premier moyen, que l’article 5, deuxième alinéa, du règlement 1049/2001 doit être entendu en ce sens que la transmission, par un État membre, d’une demande d’accès à un document en sa possession à une institution de l’Union habilite celle-ci à rendre une décision contraignante sur cette demande, la requérante soutient que l’article 5 ainsi compris ne peut s’appuyer ni sur l’article 15, paragraphe 3, TFUE ni sur l’article 255 TCE comme base légale appropriée, et qu’en conséquence, la disposition de l’article 5 n’est pas valide. In the event that the General Court should find, contrary to the arguments put forward in the context of the first plea in law, that the second paragraph of Article 5 of Regulation (EC) No 1049/2001 has to be interpreted as meaning that the transmission, by a Member State to an institution of the European Union, of a request for access to a document which is held by that Member State empowers that institution to take a binding decision in regard to that request, the applicant submits that Article 5, thus construed, cannot be based on Article 15(3) TFEU or on Article 255 EC as its proper basis and is for that reason invalid. In addition, that provision, thus construed, is incompatible with the grounds of Regulation No 1049/2001, which results in its invalidity in the light of Article 296 TFEU (Article 253 EC).

Secondly, the Commission contends that the note of 28 July 2009, which the applicant entitled ‘Complaint’ within the meaning of Article 90(2) of the Staff Regulations, was no more than a request for documents, and did not have the minimum content required for a ‘prior administrative complaint’ within the meaning of the provisions of the Staff Regulations, which is why that note did not have the effect of suspending the time-limit of three months and ten days before the matter could be referred to the Tribunal.
