(17) Si le gouverneur en conseil est convaincu qu’une invention relative à tout instrument ou munition de guerre, décrite dans une demande spécifiée de brevet non cédée au ministre de la Défense nationale, est essentielle à la défense du Canada et que la publication d’un brevet en l’espèce devrait être empêchée afin de maintenir la sécurité de l’État, il peut ordonner que ces invention et demande ainsi que tous les documents s’y rattachant soient traités, pour l’application du présent article, comme si l’invention avait été cédée, ou comme s’il avait été convenu de céder l’invention, au ministre de la Défense nationale.
(17) The Governor in Council, if satisfied that an invention relating to any instrument or munition of war, described in any specified application for patent not assigned to the Minister of National Defence, is vital to the defence of Canada and that the publication of a patent therefor should be prevented in order to preserve the safety of the State, may order that the invention and application and all the documents relating thereto shall be treated for all purposes of this section as if the invention had been assigned or agreed to be assigned to the Minister of National Defence.

(Return tabled) Question No. 566 Mr. Mark Holland: With regard to GRK Fasteners: (a) on what grounds are duties, under the Special Import Measures Act (SIMA), applied; (b) on what grounds was their petition to the Canadian International Trade Tribunal (CITT) for a SIMA exempt status denied; (c) given that GRK’s request for exemption is based on the fact that all of their products are patented, is the CITT no longer recognizing that patents make a product unique; (d) was the fact that there are no domestic manufacturers able to provide GRK with the type of product they require taken into account when the CITT made their decision and, if so, why is the SIMA duty still imposed on them and, if not, why not; and (e) does the Canada Border Services Agency or any other department or agency have reason to believe that GRK Fasteners has ever engaged in product dumping and, if so, what evidence do they possess and, if not, how then can an anti-dumping duty be applied to GRK?

The Commission has published several reports required by the Directive. On 14 January 2002 it published "An assessment of the implications for basic genetic engineering research of failure to publish, or late publication of, papers on subjects which could be patentable" and on 7 October 2002, it published the first annual report on "Development and implications of patent law in the field of biotechnology and genetic engineering" (IP/02/1448).
