Notwithstanding the possible use of computerised procedures, all natural or legal persons, groups of persons, including traders who do not hold stocks, who have their domicile or registered place of business within the customs territory of the Community and who transport a wine product or have a wine product transported shall draw up on their own responsibility a document to accompany that consignment, hereinafter called ‘the accompanying document’.

12. Si un document d’informations clés doit être établi pour des valeurs mobilières offertes au public au titre du règlement (UE) no 1286/2014 et si un État membre d’origine exige de l’émetteur, de l’offreur ou de la personne qui sollicite l’admission à la négociation sur un marché réglementé de remplacer le contenu dudit document conformément au paragraphe 7, deuxième alinéa, deuxième phrase, du présent article, les personnes qui donnent des conseils au sujet des valeurs mobilières, ou qui les vendent, au nom de l’émetteur, de l’offreur ou de la personne sollicitant l’admission à la négociation sur un marché réglementé sont réputées avoir satisfait, au cours de la période d’offre, à l’obligation de fournir un document d’informations clés conformément à l’article 13 du règlement (UE) no 1286/2014, pour autant qu’elles fournissent à la place aux investisseurs concernés le résumé du prospectus dans le délai et les conditions prévus aux articles 13 et 14 dudit règlement.
12. Where a key information document is required to be prepared for securities offered to the public under Regulation (EU) No 1286/2014 and a home Member State requires the issuer, the offeror or the person asking for admission to trading on a regulated market to substitute the content of the key information document in accordance with the second sentence of the second subparagraph of paragraph 7 of this Article, the persons advising on or selling the securities on behalf of the issuer, the offeror or the person asking for admission to trading on a regulated market shall be deemed to have fulfilled, during the offer period, the obligation to provide the key information document in accordance with Article 13 of Regulation (EU) No 1286/2014, provided that they instead provide the investors concerned with the summary of the prospectus under the timing and conditions set out in Articles 13 and 14 of that Regulation.

Notes that international agreements have binding force and an impact on EU legislation, and points to the need for negotiations to be transparent throughout the entire process, implying that the institutions should publish the negotiating mandate conferred on the EU negotiator without undermining the EU’s negotiating position; considers that documents related to international agreements should be public in principle, without prejudice to legitimate exceptions and without undermining the trust necessary between the parties concerned to achieve effective negotiations; regrets that the Commission and the Council routinely classify all documents relating to negotiations, thereby limiting citizens’ access to information; maintains that the public should be given access to all relevant negotiating documents, including those already agreed on, with the exception of those which are considered sensitive, with a clear justification on a case-by-case basis, in accordance with Article 9 of Regulation (EC) No 1049/2001.

Notes the fact that the Commission has made real efforts to make the TTIP negotiating process more transparent, especially in the light of the publication of the European directives for the negotiations on the TTIP (1103/13 CL 1); notes that this essential document was only disclosed on 9 October 2014 while the negotiations started in June 2013; recalls that the Commission is in all circumstances legally obliged to comply with the rules on public access to documents set out in Regulation 1049/2001; regrets that the access given to Members of the European Parliament to TTIP negotiating texts has been to date extremely limited; highlights that the documents available in the EP secured reading room do not contain any consolidated material or any text tabled by the US; highlights the need to ensure transparency through a direct and open dialogue in the form of public consultations with all stakeholders;

11. salue l'enquête de la Médiatrice européenne sur la nécessité d'une divulgation plus proactive des documents; invite la Commission à mettre rapidement en œuvre les recommandations de la Médiatrice relatives à l'accès du public aux textes de négociation consolidés, à l'amélioration de la divulgation proactive des documents liés au partenariat transatlantique, et au renforcement de la transparence en ce qui concerne les réunions sur le partenariat entre les fonctionnaires de la Commission et les organisations professionnelles, les groupes de pression ou les ONG; est convaincu qu'une démarche plus proactive en matière de transparence de la part de la Commission est susceptible de renforcer la légitimité du processus de négociation aux yeux des citoyens et de le rendre plus démocratique, et exhorte dès lors la Commission à publier l'ensemble des documents de négociation, y compris les offres des États-Unis adressées à l'Union, à la manière des pratiques standard appliquées à l'ensemble des négociations commerciales internationales menées dans le cadre de l'Organisation mondiale du commerce, et à promouvoir une participation et une association plus complètes des diverses parties prenantes dans le cadre du processus de négociation, en particulier, de la société civile et des organisations de consommateurs;

Welcomes the inquiry of the European Ombudsman regarding the need for a more proactive disclosure of the documents; urges the Commission to rapidly implement the Ombudsman’s recommendations related to public access to consolidated negotiating texts, greater proactive disclosure of TTIP documents and increased transparency as regards meetings held by Commission officials on TTIP with business organisations, lobby groups or NGOs; believes that a more proactive approach to transparency on the part of the Commission could make the negotiating process more democratic and legitimate in the eyes of citizens, and therefore urges the Commission to publish all negotiating documents, including US offers to the EU, following the practice for all international trade negotiations conducted within the framework of the World Trade Organisation, and to promote more comprehensive participation and involvement of the various stakeholders in the negotiating process, and in particular of civil society and consumers’ organisations;

(i) tenir pleinement compte du besoin de transparence et de responsabilité tout au long du processus de négociations et respecter son obligation de tenir le Parlement immédiatement et pleinement informé, à toutes les phases des négociations, conformément à l'article 218, paragraphe 10, du traité FUE, dont la Cour de justice de l'Union européenne a récemment confirmé le caractère contraignant; garantir l'accès des citoyens aux documents pertinents utilisés lors des négociations émanant de toutes les parties, à l'exception de ceux qui doivent être classifiés, moyennant une justification claire, au cas par cas, qui indique publiquement la mesure dans laquelle l'accès aux parties confidentielles du document en question risque de compromettre concrètement et effectivement les intérêts garantis par les exceptions prévues, conformément au règlement (CE) nº 1049/2001 du Parlement européen et du Conseil du 30 mai 2001 relatif à l'accès du public aux documents du Parlement européen, du Conseil et de la Commission; veiller à ce que l'accord n'entrave en aucune manière les dispositions législatives de l'Union ou de ses États membres relatives à l'accès du public aux documents officiels;
(i) to show full regard for the need for transparency and accountability in the negotiations throughout the entire process, and to fulfil its obligation under Article 218(10) TFEU, which a recent Court of Justice ruling confirmed as being of statutory character, to keep Parliament fully informed on an immediate basis at all stages of the negotiations; to ensure public access to relevant negotiation documents from all parties, with the exception of those which are to be classified with clear justification on a case-by-case basis, with a public justification of the extent to which access to the undisclosed parts of the document in question is likely to specifically and actually undermine the interests protected by the exceptions, in line with Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents; to ensure that the agreement in no way weakens the laws of the EU or of its Member States on public access to official documents;
