Having regard to the Internal Agreement between the Representatives of the Governments of the Member States, meeting within the Council, on the financing of Community aid under the multiannual financial framework for the period 2008 to 2013 in accordance with the ACP-EC Partnership Agreement and on the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies (3) (the ‘Internal Agreement’) setting up, amongst others, the 10th European Development Fund (10th EDF), and in particular Article 11(8) thereof,

– having regard to the financial statements and revenue and expenditure accounts for the eighth, ninth and tenth European Development Funds for the financial year 2013 (COM(2014)0487 – C8-0146/2014),

– vu le rapport annuel de la Commission du 14 avril 2014 sur la gestion financière des huitième, neuvième et dixième Fonds européens de développement pour l'exercice 2013,
– having regard to the Commission’s annual report of 14 April 2014 on the financial management of the eighth, ninth and tenth European Development Funds for the financial year 2013,

– vu ses décisions du 3 avril 2014 concernant la décharge sur l'exécution du budget des huitième, neuvième et dixième Fonds européens de développement pour l'exercice 2012 , et du 3 avril 2014 concernant la clôture des comptes des huitième, neuvième et dixième Fonds européens de développement pour l'exercice 2012 , ainsi que sa résolution du 3 avril 2014 contenant les observations qui font partie intégrante de la décision concernant la décharge sur l'exécution du budget des huitième, neuvième et dixième Fonds européens de développement pour l'exercice 2012 ;
– having regard to its decisions of 3 April 2014 on discharge in respect of the implementation of the budget for the Eighth, Ninth and Tenth European Development Funds for the financial year 2012 , and of 3 April 2014 on the closure of the accounts of the Eighth, Ninth and Tenth European Development Funds for the financial year 2012 , and to its resolution of 3 April 2014 with observations forming an integral part of its decision on discharge in respect of the implementation of the budget for the Eighth, Ninth and Tenth European Development Funds for the financial year 2012 ,

Les requérantes font grief à la Commission d’avoir adressé au gouvernement néerlandais, à propos d’une enquête de l’Office européen de lutte antifraude («OLAF») qui n’est pas encore clôturée et dans laquelle celui-ci n’a encore rendu aucun rapport (définitif), des lettres dans lesquelles elle cite nommément les requérantes et indique, ou, du moins, suggère avec insistance, que les requérantes se seraient rendues coupables d’irrégularités dans le cadre de la gestion du neuvième Fonds européen de développement, raison pour laquelle elle a décidé de ne pas confier aux requérantes la gestion des projets prévus pour les anciennes Antilles néerlandaises dans le cadre du dixième Fonds européen de développement.
The applicants allege that the defendant sent letters to the Netherlands Government about a pending investigation conducted by the European Anti-Fraud Office (OLAF), in respect of which no (final) report has yet been produced, but which expressly name the applicants and which indicate, or at least very strongly suggest, that the applicants are involved in irregularities in the context of the management of the 9th European Development Fund project, and accordingly, on the basis of that allegation, decided that the implementation of the 10th European Development Fund for the projects on the former Netherlands Antilles could not be assigned to the applicants.
