D. considérant que Nabeel Rajab, défenseur des droits de l'homme à Bahreïn, président du Centre pour les droits de l'homme de Bahreïn (BCHR), secrétaire général adjoint de la Fédération internationale des droits de l'homme (FIDH) et membre du comité consultatif de la division Moyen-Orient de Human Rights Watch, a été condamné à six mois de prison seulement pour avoir exercé pacifiquement son droit à la liberté d'expression; considérant que Nabeel Rajab a été arrêté le 1 octobre 2014 après sa visite à la sous-commission "droits de l'homme" du Parlement européen car accusé d'avoir posté des tweet concernant un groupe de compatriotes présumé coopérer avec l'EI; considérant qu'il a été accusé d'insulte à une institution publique et à l'armée; considérant qu'en novembre 2013, le groupe de travail des Nations unies sur la détention arbitraire a qualifié d'arbitraire la détention de Nabeel Rajab;
D. whereas Nabeel Rajab, Bahraini human rights defender and President of the Bahrain Center for Human Rights (BCHR), Deputy Secretary-General of the International Federation for Human Rights (FIDH) and member of the Advisory Committee of Human Rights Watch’s Middle East Division, was sentenced to six months imprisonment simply for peacefully exercising his freedom of expression; whereas Nabeel Rajab was arrested on 1 October 2014 after his visit to the Subcommittee on Human Rights of the European Parliament on accusations of posting tweets about a group of his countrymen allegedly cooperating with IS/Da’esh; whereas he was charged with insulting a public institution and the army; whereas in November 2013 the United Nations Working Group on Arbitrary Detention described the detention of Mr Nabeel Rajab as arbitrary;

The European Consensus on Development of 22 December 2005 and the Council Conclusions of 14 May 2012 on ‘Increasing the impact of EU development policy: an Agenda for Change’ should provide the general policy framework to guide the programming and implementation of the 11th EDF, including the internationally agreed principles on aid effectiveness, such as the principles set out in the Paris Declaration on Aid Effectiveness (2005), the EU Code of Conduct on Division of Labour in Development Policy (2007), the EU Guidelines for the Accra Agenda for Action (2008), the EU common position, including on the EU Transparency Guarantee and other aspects of transparency and accountability, for the fourth High Level Forum on Aid Effectiveness in Busan, which resulted in, inter alia, the Busan Outcome Document (2011), the Gender Action Plan for external action (2010) and the United Nations Convention on the Rights of Persons with Disabilities to which the Union is a party.

Je voudrais toutefois profiter de cette occasion pour intervenir et attirer l’attention du Parlement sur un nouvel élément qui ne concerne plus les minorités, les violations des droits de l’homme dans le monde, les réfugiés économiques ou politiques, les sous-groupes européens, les minorités religieuses, les homosexuels etc., mais qui concerne les Européens eux-mêmes qui, en raison de la tempête prévue en ce début de crise économique internationale, seront divisés en catégories qui nécessitent la protection de leurs droits fondamentaux.
However, I would take this opportunity to intervene and to draw Parliament’s attention to a new element which no longer concerns minorities, infringements of human rights globally, economic or political refugees, European sub-groups, religious minorities, homosexuals and so on, but which does concern Europeans themselves who, because of the storm anticipated in the wake of the international economic crisis, will be divided into categories which need protection of their human rights.

For instance, we met with the Director General of Human Rights, the head of the division for equality between women and men, the head of the execution of judgments of the European Court of Human Rights, and the administrator of the European Committee for the Prevention of Torture.

Je pense que le résultat du travail de la Convention devra être un texte cohérent, obéissant à une logique propre et non une simple liste de tâches à réaliser ; un texte adopté par consensus, c'est-à-dire sans recourir à l'unanimité à tout prix et qui, pour ne pas renoncer à son indispensable ambition, fasse apparaître les opinions minoritaires ; un texte simplifié, plus facile à lire, qui exprime clairement tant les principes qui animent notre action - et la Charte des droits fondamentaux doit en être le cœur - que les objectifs que nous poursuivons ; un texte qui rende transparente l'organisation des pouvoirs publics européens, c'est-à-dire qui décrive clairement tant les institutions que les instruments nécessaires pour atteindre les objectifs qui leur ont été assignés ; enfin, un texte capable d'évoluer et qui, à cette fin, soit divisé entre un ensemble de règles fondamentales et de dispositions à caractère plus technique.
What the Convention should, in my view, produce is a coherent text, underpinned by its own logic, not a mere shopping list; a text adopted by consensus, which therefore does not seek unanimity at any price and which, to avoid scaling down its essential ambitions, voices minority views where necessary; a simpler, more easily readable text which clearly sets out not only the principles guiding our action – and the Charter of Fundamental Rights should be at the heart of those principles – but also the goals to which we are aspiring; a text which makes the way in which the European public authorities work more transparent, that is which gives a clear description of both the institutions and the instruments necessary for achieving the objectives they are assigned; and lastly, a text that is capable of evolving and is therefore, to this end, a combination of a set of fundamental rules and some more technical provisions.

M. Mr. Blair Hankey (Associate General Counsel, Trade Law Division, Department of Foreign Affairs and International Trade): Unreasonable is clearly a broader term than discriminatory, and it's a term that has come in from a number of European bilateral investment agreements.
