5. If a deduction according to paragraphs 1 and 2 cannot be operated on the quota, allocation or share of a stock or group of stocks that was overfished as such because that quota, allocation or share of a stock or group of stocks is not or not sufficiently available to the Member State concerned, the Commission, after consultation of the Member State concerned, may deduct in the following year or years quotas for other stocks or groups of stocks available to that Member State in the same geographical area, or with the same commercial value in accordance with paragraph 1.

3. Si l'autorité compétente vient à disposer d'éléments d'information susceptibles d'avoir des conséquences du point de vue des risques que comportent le ou les OGM pour la santé humaine ou l'environnement, ou dans les circonstances décrites au paragraphe 2, elle transmet immédiatement l'information à la Commission et aux autorités compétentes des autres États membres et elle peut invoquer les dispositions prévues à l'article 15, paragraphe 1, et à l'article 17, paragraphe 7, le cas échéant, si elle dispose de ces éléments d'information avant de donner son autorisation écrite.
3. If information becomes available to the competent authority which could have consequences for the risks of the GMO(s) to human health or the environment, or under the circumstances described in paragraph 2, it shall immediately forward the information to the Commission and the competent authorities of the other Member States and may avail itself of the provisions in Articles 15(1) and 17(7) where appropriate, when the information has become available before the written consent.
