Considers that the product of the successive IGCs, namely an accumulation of long and complicated Treaties, has become difficult to use both for experts and for the general public, and that the current Treaties should therefore be replaced by a single "framework Treaty" which is clear and concise and which provides for the merging of the European Union and the three Communities into a single entity; that Treaty would be restricted to fundamental constitutional provisions, covering the objectives of the Union, the protection of fundamental rights, citizenship, the allocation of powers, and institutional matters; all other provisions, including those governing common policies, would be set out in protocols annexed to the "framework Treaty";

What is required is to define a number of basic rules which, having regard on the one hand to firms' needs for flexibility and on the other, the aspirations of a number of workers, aim -while taking into account the diverse situations in the Member States and the autonomy of management and labour- to : - prevent any spread in the increasing prevalence of insecurity and segmentation on the labour market and promote an improvement in workers' living and working conditions, notably by ensuring that the employees concerned by such relationships enjoy treatment comparable to that enjoyed by employees working full time for an indefinite duration, for example as regards access to training and social services; - eliminate the distortions of competition which could be caused by differences in the social costs resulting in particular from differences in the national rules governing these employment relationships, notably in relation to social security schemes and the costs connected with seniority and dismissals; ./.

It is important, therefore, that the Commission is able to rely on the Member States' expertise in order to guarantee more effectively the continued development of Community law and the implementation of the basic instruments drawn up by the Council in accordance with objective and recognized criteria; - Strengthening of control rules, notably in the field of public procurement, to ensure correct and consistent implementation in all the Member States.

L'UE aborde la session plénière finale de juin animée de la volonté de parvenir à un accord sur un compromis global, sous réserve de solutions satisfaisantes à ses préoccupations fondamentales.

Nevertheless, to achieve this goal, there remain certain areas where improvements will need to be made, notably in the fields of trade and investments, including the need for full consistency of the commercial provisions of the Energy Charter Treaty with the relevant provisions of the Treaties and agreements concluded or to be concluded in accordance with those provisions, recalling in particular the agreements being negotiated or to be negotiated with the Countries of Central and Eastern Europe and the Republics of the Commonwealth of Independent States. 4. The EU enters the final Plenary in June ready to reach agreement on a comprehensive package, subject to the satisfactory solution of its fundamental concerns.
