Calls on the Commission to incorporate specific provisions on the role of organised crime in the legislative framework applicable to the fight against counterfeiting; endorses the decisions set out in the Council resolution of 23 October 2009 on a reinforced strategy for customs cooperation, with particular reference to the development of new forms of cooperation and new investigative techniques, the adoption of an institutional approach based on cooperation between customs services, the police and other competent authorities, and improvements to the existing cooperation process in order to develop an effective approach to fighting cross-border organised crime and allow the confiscation of illicit goods across the EU; maintains that the greatest possible emphasis must be placed on these aspects in the context of the adoption and implementation of the Fifth Action Plan for Customs Law Enforcement Cooperation;

L'article 12 quater, paragraphe 2, du protocole dispense l'Andorre de l'obligation d'appliquer les mesures douanières de sécurité (dispositions relatives à la déclaration des marchandises préalablement à leur introduction dans le territoire douanier ou à leur sortie de ce territoire douanier, aux opérateurs économiques agréés ainsi qu'aux contrôles douaniers de sécurité et à la gestion des risques en matière de sécurité) définies à l'article 12 ter, paragraphe 1, au transport des marchandises entre les territoires douaniers de l'Union européenne et de l'Andorre, aussi longtemps que les parties s'engagent à les appliquer et à garantir un niveau de sécurité équivalent aux frontières externes.
Article 12c(2) of the Protocol exempts Andorra from the obligation to apply customs security measures (provisions concerning the declaration of goods prior to their entry and exit from this customs territory, authorised economic operators, and customs security checks and risk management) set out in Article 12b(1) to the carriage of goods between the customs territories of the EU and Andorra for as long as the parties undertake to apply them and ensure an equivalent level of security at the external borders.
