1. La responsabilité contractuelle de l’entreprise commune IMI2 est régie par les dispositions contractuelles applicables et par le droit applicable à la convention ou décision ou au contrat en question.
1. The contractual liability of the IMI2 Joint Undertaking shall be governed by the relevant contractual provisions and by the law applicable to the agreement, decision or contract in question.

2. Member States shall require institutions to include in the contractual provisions governing any eligible liability, Additional Tier 1 instrument or Tier 2 instrument that is governed by the law of a jurisdiction that is not a Member State a term by which the creditor or party to the agreement creating the liability recognises that the liability may be subject to the write down and conversion powers and agrees to be bound by any reduction of principal or outstanding amount due, conversion or cancellation that is effected by the exercise of the those powers by a resolution authority.

7. The transmission system operator shall without undue delay inform the trading platform operator of network user’s losing the right to make trade notifications pursuant to the applicable contractual arrangement in force which shall result in the suspension of the network user’s right to trade on the trading platform, without prejudice to the other remedies that could be available in such case to the trading platform operator under the applicable rules of the trading platform.
