The Commission states that although the Rules of Procedure of the Civil Service Tribunal, unlike those of the General Court, do not provide for the adoption of a measure of inquiry ordering the parties to the dispute to produce documents, Article 24 of the Statute of the Court of Justice, which is applicable to the Civil Service Tribunal, would have permitted the adoption of such a measure since that provision permits, inter alia, the Courts of the European Union to require the parties to produce all documents and to supply all information which they consider desirable.

(4) Whereas Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural Funds(5) institutes a comprehensive review of the operational arrangements for the structural policies to take effect from 1 January 2000; whereas such structural measures will form part of the means and tasks referred to in Article 2 of the said Regulation; whereas Council Regulation (EEC) No 2080/93 of 20 July 1993 laying down provisions for implementing Regulation (EEC) No 2052/88 as regards the Financial Instrument for Fisheries Guidance(6) should therefore be repealed and replaced by a new Regulation providing in particular for arrangements that will ensure a transition which avoids any interruption of the structural measures,

(13) Whereas the limits within and the conditions under which the ECB is entitled to impose sanctions on undertakings for failure to comply with the obligations laid down in regulations and decisions of the ECB have been defined by Council Regulation (EC) No 2532/98 of 23 November 1998, concerning the powers of the European Central Bank to impose sanctions (5), in accordance with Article 34.3 of the Statute; whereas in the event of a conflict between the provisions of the said Regulation and this Regulation enabling the ECB to impose sanctions, the provisions of this Regulation will prevail; whereas the sanctions for non-compliance with the obligations set out in this Regulation are without prejudice to the possibility of the ESCB establishing appropriate enforcement provisions in its relations with counterparties, including the partial or total exclusion of a reporting agent from monetary policy operations in the case of a serious infringement of statistical reporting requirements;

(9) considérant qu'il convient d'instaurer une procédure pour arrêter certaines dispositions de nature particulière concernant les eaux minérales naturelles, notamment en ce qui concerne les limites de concentration de certains constituants des eaux minérales naturelles; qu'il convient également d'adopter des dispositions prévoyant l'indication, dans l'étiquetage, des concentrations élevées de certains constituants; qu'il convient de déterminer des méthodes d'analyse, y compris les limites de détection, destinées à vérifier l'absence de contamination des eaux minérales naturelles, ainsi que des procédures d'échantillonnage et des méthodes d'analyse pour le contrôle des caractéristiques microbiologiques de ces eaux;
(9) Whereas a procedure to lay down certain detailed provisions concerning natural mineral waters, notably in respect of the limits for the levels of certain constituents of natural mineral waters, should be established; whereas provisions for the indication, on labelling, of high levels of certain constituents should also be adopted; whereas methods of analysis, including limits of detection, to check the absence of pollution of natural mineral waters, and sampling procedures and methods of analysis for checking the microbiological characteristics of natural mineral waters, should be determined;
