Par dérogation à l'article 31, paragraphe 2, à l'article 32, paragraphe 4, et à l'article 37, paragraphe 1, du règlement (CE) no 1260/1999 du Conseil du 21 juin 1999, portant dispositions générales sur les Fonds structurels , les sommes engagées pour une intervention cofinancée par l'Instrument financier d'orientation de la pêche (IFOP) établi par le règlement (CE) no 1263/1999 du Conseil du 21 juin 1999 relatif à l'instrument financier d'orientation de la pêche , approuvée par la Commission entre le 1er janvier 2000 et le 31 décembre 2006, et pour lesquelles l'état certifié des dépenses effectivement supportées, le rapport final d'exécution, y compris l'état d'avancement visé à l'article 1er, paragraphe 1, du règlement (CE) no 366/2001 de la Commission et la déclaration visée à l'article 38, paragraphe 1, point f), du règlement (CE) no 1260/1999 du Conseil, n'ont pas été transmis à la Commission dans les quinze mois après la date ultime d'éligibilité des dépenses fixée dans la décision d'octroi d'une participation de l'IFOP, sont dégagées d'office par la Commission au plus tard six mois après l'échéance en question, ce qui donne lieu au remboursement des sommes indues.

By way of derogation from Articles 31(2), 32(4) and 37(1) of Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural Funds , sums committed for assistance co-financed by the Financial Instrument for Fisheries Guidance (FIFG), established by Council Regulation (EC) No 1263/1999 of 21 June 1999 on the Financial Instrument for Fisheries Guidance , approved by the Commission between 1 January 2000 and 31 December 2006 for which the certified statement of expenditure actually paid, the final report on implementation, comprising also the progress report referred to in Article 1(1) of Commission Regulation (EC) No 366/2001 , and the declaration referred to in Article 38(1)(f) of Regulation (EC) 1260/1999 have not been sent to the Commission within 15 months after the final date of eligibility of expenditure laid down in the decision granting a contribution from the FIFG, shall be automatically decommitted by the Commission not later than six months after that deadline, giving rise to the repayment of amounts unduly paid.

That means the presumed expectations of an average consumer who is reasonably well informed and reasonably observant and circumspect (see, to that effect, in relation to Article 3(1)(b) of First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (OJ 1989 L 40, p. 1), which is identical to Article 7(1)(b) of Regulation No 40/94, Case C-218/01 Henkel [2004] ECR I-0000, paragraph 50 and the case-law cited there; see also Joined Cases C-456/01 P and C-457/01 P Henkel v OHIM [2004] ECR I-0000, paragraph 35 and the case-law cited there).

2. A Member State which, after the Directive has been brought into force, for reasons of a technical nature has substantial problems in opening its market for certain limited groups of the non-household customers referred to in Article 21(1)(b) may apply for derogation from this provision, which may be granted to it by the Commission for a period not exceeding 18 months after the date referred to in Article 30(1).
