Notes that only a limited number of developing countries participate in the TiSA negotiations; reiterates the need for a strengthened multilateral approach to global trade, to be achieved by means of intensified cooperation between the EU and democratic international bodies, such as the UN and the WTO, in which developing countries are properly represented; notes that TiSA should be based on the WTO General Agreement on Trade in Services (GATS), to which all WTO members are parties; recalls, however, its rejection of any provision that would be incompatible with GATS and that would prevent future integration into the WTO system; calls on the Commission to take into account the impact of TiSA on countries that are not part of the negotiations, especially developing countries, and to include in TiSA the provisions contained in GATS Article IV;

Lorsqu’une question relative à la validité ou à l’interprétation du présent accord est soulevée dans une affaire en instance devant une juridiction danoise, cette juridiction demande à la Cour de justice de se prononcer sur cette question chaque fois que, dans les mêmes circonstances, une juridiction d’un autre État membre de l’Union européenne serait tenue de le faire à l’égard du règlement Bruxelles I et de ses dispositions d’exécution visées à l’article 2, paragraphe 1, du présent accord.
1. Where a question on the validity or interpretation of this Agreement is raised in a case pending before a Danish court or tribunal, that court or tribunal shall request the Court of Justice to give a ruling thereon whenever under the same circumstances a court or tribunal of another Member State of the European Union would be required to do so in respect of the Brussels I Regulation and its implementing measures referred to in Article 2(1) of this Agreement.

28. Considers that an easily understandable brochure in all official languages of the European Union would be useful for undertakings and for lorry drivers; stresses that this brochure should give the drivers and undertakings concerned more information about the relevant social rules and the penalties applicable to infringements in the various Member States; considers that such information should also be made available to undertakings and drivers from third countries; draws attention to the value of using intelligent transport systems to provide drivers with such information in real time;

serait incompatible avec les principes et les objectifs de l’Union en matière d’action extérieure, développés conformément aux dispositions générales énoncées au chapitre I du titre V du traité sur l’Union européenne; ou
be inconsistent with the Union’s principles and objectives for external action as elaborated in accordance with the general provisions laid down in Chapter 1 of Title V of the Treaty on European Union; or

F. considérant que le principe d'égalité face à la loi imposerait que les citoyens européens aient accès aux mêmes conditions de parité non seulement face à la législation de l'Union européenne, mais également face à la législation nationale de transposition, et qu'il serait dès lors souhaitable que, dans le contexte de l'échéance des délais de transposition d'une disposition européenne, les États membres, outre une référence explicite dans les dispositions de transposition, publient au Journal officiel quelles sont les dispositions nationales portant application de la disposition en question et quelles sont les autorités nationales chargées de leur application,
F. whereas the principle of equality before the law requires that European citizens should enjoy equality in respect not only of European Union legislation but also of the national legislation transposing it. It would therefore be highly expedient if, on expiry of the deadlines for transposing the European law, the Member States not only included an explicit reference in the transposition provisions, but also indicated in their Official Journals which national provisions are intended to apply the law in question and which national authorities are responsible for their implementation,

The Minister, Mr Kovacs, stated that the law would be amended so that it could be applied without impacting on neighbouring countries, in complete accordance with European standards and provisions.

In this respect, an assessment of the adequacy of the resources available to the European Community humanitarian aid would be appropriate in light of its comparative advantage.

Consequently, a Member State which has not issued a declaration according to Article 41(2) of the Decision, but nevertheless has kept incompatible national law provisions, would be in breach of the Decision and the TEU since 6 March 2002.
