IN-CONTEXT TRANSLATIONS

L’annexe du règlement (CE) no 1033/2006 de la Commission du 4 juillet 2006 définissant les règles en matière de procédures applicables aux plans de vol durant la phase préalable au vol dans le ciel unique européen fait référence à plusieurs dispositions établies par l’Organisation de l’aviation civile internationale (ci-après dénommée l’«OACI») et applicables à la soumission, l’acceptation et la diffusion des plans de vol ainsi qu’aux modifications d’éléments essentiels d’un plan de vol pendant la phase préalable au vol. Depuis l’adoption du règlement (CE) no 1033/2006 et du règlement (UE) no 929/2010 de la Commission du 18 octobre 2010 modifiant le règlement (CE) no 1033/2006 en ce qui concerne les dispositions relatives à l’OACI visées à l’article 3, paragraphe 1 , lesdites dispositions ont été modifiées par l’OACI.
The Annex to Commission Regulation (EC) No 1033/2006 of 4 July 2006 laying down the requirements on procedures for flight plans in the pre-flight phase for the single European sky refers to various provisions applying to the submission, acceptance and distribution of flight plans, as well as to changes to key items in a flight plan in the pre-flight phase, which are laid down by the International Civil Aviation Organisation (hereinafter ICAO). Since the adoption of Regulation (EC) No 1033/2006 and Commission Regulation (EU) No 929/2010 of 18 October 2010 amending Regulation (EC) No 1033/2006 as regards the ICAO provisions referred to in Article 3(1) those provisions have been amended by ICAO.

Notes that patent challenges are often commercial disputes and is concerned that applying ACTA civil enforcement provisions to patents may increase investment risk, market uncertainty and threaten technological innovation, particularly in sectors where infringement is difficult to determine, slow down the diffusion of green technology essential to global efforts to combat climate change, threaten effective knowledge sharing, development of the economy of the commons and the vitality of the public domain, and shift the balance against the public interest with respect to enforcement of patents on living things, indigenous products and traditional medicines; asks the Commission to address, before the initialling of the Agreement, the far ranging concerns listed in this motion with regards to the option of applying civil provisions to patents and subsequently present a report to Parliament;

Asserts that marked increases in damages and in other remedies for possible IPR violations could deter manufacturers and third parties involved in the production, sale or distribution of affordable generic medicines, particularly if these provisions are applied to in-transit goods; is concerned that applying civil enforcement provisions to patents in ACTA could go against the public interest, and may increase investment risk, market uncertainty and threaten technological innovation, particularly in sectors where infringement is difficult to determine, or in enforcing patents on living organisms, indigenous products and traditional medicines; asks the Commission to address, prior to the initialling of the agreement, the far-ranging concerns listed in this resolution with regard to the option of applying civil-law provisions to patents and subsequently present a report to Parliament;

Emphasises the numerous obstacles that have been identified to the rapid deployment of civil missions; calls on the Member States to encourage their Justice and Interior Ministries to take due responsibility in this area; supports the Council's efforts to facilitate the secondment and deployment of qualified, appropriately trained and gender-balanced civilian personnel (through the adoption of national strategies and common standards, improvements to the force generation process and pre-deployment training, a revised concept of civilian response teams (CRTs)) and the rapid provision of equipment for new civil missions (by means of framework contracts and a permanent warehouse project); welcomes, in this connection, the decision to set up a temporary equipment warehouse as part of the EU Police Mission in Bosnia and Herzegovina;

Nonobstant les dispositions du paragraphe 1 du présent article, la présente convention ne s'applique pas lorsque le transport est soumis à un régime de responsabilité civile prévu par les dispositions de toute autre convention internationale sur le transport de passagers ou de bagages par un mode de transport différent, pour autant que ces dispositions doivent être appliquées au transport par mer.
2. Notwithstanding paragraph 1 of this Article, this Convention shall not apply when the carriage is subject, under any other international convention concerning the carriage of passengers or luggage by another mode of transport, to a civil liability regime under the provisions of such convention, in so far as those provisions have mandatory application to carriage by sea.

Conformément à l’article 4 de l’accord du 19 octobre 2005 entre la Communauté européenne et le Royaume de Danemark sur la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale (ci-après, «l’accord»), conclu par la décision 2006/325/CE du Conseil , lorsque des dispositions d’exécution sont adoptées en vertu de l’article 74, paragraphe 2, du règlement (CE) no 44/2001 du Conseil du 22 décembre 2000 concernant la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale , le Danemark notifie à la Commission sa décision d’appliquer ou non le contenu de ces dispositions.
According to Article 4 of the Agreement of 19 October 2005 between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (hereinafter ‘the Agreement’), concluded by Council Decision 2006/325/EC , whenever implementing measures are adopted pursuant to Article 74(2) of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters , Denmark’s decision on whether or not to implement the content of such measures shall be notified to the Commission.
