By fax of 14 June 2012, the Commission informed the French authorities that the scope of the case would be expanded, as an analysis of the information available had shown that a de minimis regulation had not been applied properly, thereby transforming into non-notified aid a measure that, had the de minimis regulation been applied properly, would not have constituted State aid within the meaning of Article 107(1) TFEU.

C. considérant que l'évaluation des crédits mobilisés au titre du FEM entre 2007 et la fin du premier semestre 2009 révèle une mise en œuvre limitée des moyens affectés, 80 millions d'euros seulement ayant été mobilisés sur un total de 1,5 milliard d'euros qui étaient théoriquement disponibles, pour 18 candidatures, au bénéfice de 24 431 travailleurs, et de 8 États membres, concernant un nombre très restreint de secteurs (notamment les industries textile et automobile); considérant que ces insuffisances sont également illustrées par les écarts constatés entre le niveau des montants initialement alloués et ceux finalement exécutés, 24,8 millions d'euros ayant été remboursés a posteriori au titre des 11 premiers cas, soit 39,4 % des montants mobilisés,
C. whereas an analysis of the funds mobilised under the EGF between 2007 and the end of the first half of 2009 highlights modest implementation of the allocated resources, with only EUR 80 million having being mobilised, out of a total of EUR 1.5 billion available, for 18 applications submitted on behalf of 24 431 workers by eight Member States for a very limited number of sectors (notably textiles and the car industry); whereas those shortcomings are also reflected in the differences between the amounts initially allocated and those finally implemented, with EUR 24.8 million (39,4% of the appropriations mobilised) having subsequently been paid back in the case of the first 11 applications,

3. Les États membres communiquent à la Commission toutes les informations disponibles relatives aux méthodes et procédés utilisés, ou présumés avoir été utilisés, pour transgresser la législation sur les droits d'accises, ayant permis de révéler des insuffisances ou lacunes dans le fonctionnement du dispositif de coopération administrative prévu par le présent règlement, lorsqu'il apparaît que de telles informations présentent un intérêt particulier pour d'autres États membres.
3. Member States shall communicate to the Commission any available information on the methods or practices used or suspected of having been used to contravene excise duty legislation which have revealed shortcomings or lacunae in the operation of the administrative cooperation arrangements provided for in this Regulation where it is deemed that such information is of particular interest to other Member States.
