Germany, which had voted against that directive in the Council, takes the view that the limit values applicable in Germany for lead, barium, antimony, arsenic and mercury offer a higher level of protection, on the basis that those values correspond to the old ‘Toys’ directive of 1988.

In the context of a comparison of the German limit values and the values laid down in the new directive for arsenic, antimony and mercury, the General Court observes that the directive establishes migration limits, the risk to health being regarded as linked to the quantity of a given harmful substance that may be released by a toy before being absorbed by a child.

Sans préjudice de l'application des restrictions définies à la première phrase du point 2, l'utilisation dans les jouets de substances classées comme étant cancérogènes, mutagènes ou toxiques pour la reproduction (CMR) par la directive 67/548/CEE à une concentration individuelle égale ou supérieure aux concentrations établies pour la classification des préparations contenant ces substances conformément aux dispositions de la directive 1999/45/CE, est interdite sauf si ces substances entrent dans la composition de jouets ou de parties de jouets micro structurellement distinctes avec lesquelles l'enfant ne peut avoir de contact physique, en ce compris l'inhalation lorsque les jouets sont utilisés dans le respect des dispositions de l'alinéa 1 de l'article 9, paragraphe 2.

Without prejudice to the application of the restrictions under the first sentence of point 2, the use in toys of substances that are classified as carcinogenic, mutagenic or toxic for reproduction (CMR) according to Directive 67/548/EEC in individual concentrations equal to or greater than the relevant concentrations established for the classification of preparations containing the substances in accordance with the provisions of Directive 1999/45/EC shall be prohibited, except if the substances are contained in components of toys or micro-structurally distinct parts of toys that are not accessible to any physical contact, including inhalation, by children if used in accordance with the first subparagraph of Article 9(2).
