Le rapporteur approuve l'approche de la présidence danoise pour ce qui est des deux dispositifs susmentionnés mais s'agissant de l'hypothèse de la confiscation "étendue", suggère de limiter la proposition aux délits relevant de la criminalité organisée conformément aux dispositions contenues dans les considérants.
Your rapporteur agrees with the approach adopted by the Danish Presidency as regards the two mechanisms referred to above, but in the case of extensive powers of confiscation suggests that the proposal be restricted to organised crime offences, which would tally with the recitals.

Votre rapporteur, chargé de ces deux propositions, renvoie, d'une manière générale, aux considérations développées dans l'exposé des motifs de son rapport sur la proposition de la Commission visant à modifier le règlement susmentionné, et notamment aux considérations d'ordre juridique dans lesquelles il conteste la possibilité pour la Commission européenne de modifier unilatéralement et sans le consentement des États membres la programmation sur sept ans arrêtée après l'adoption, lors du sommet de Berlin, de l'ensemble du dispositif structurel et financier dit Agenda 2000.
As rapporteur for both the above proposals, I would in general terms refer to the same points made in the explanatory statement to the report on the aforesaid Commission proposal for the amendment of Regulation (EC) No 2792/1999 and in particular to the points concerning legal considerations, which question whether or not the Commission can unilaterally - and without the consent of the Member States - amend the seven-year programme that was adopted following the approval at the Berlin summit of the Agenda 2000 structural and financial package.
