Au plus tard cinq ans après le 21 mai 2014, la Commission présente au Parlement européen et au Conseil un rapport sur l'application de la présente directive, sur la base d'informations tant qualitatives que quantitatives comprenant, en particulier, l'évaluation de son incidence sur la coopération en matière pénale et sur la protection des personnes physiques, ainsi que sur l'exécution des dispositions relatives à l'interception des télécommunications compte tenu des évolutions techniques.
No later than five years after 21 May 2014, the Commission shall present to the European Parliament and the Council a report on the application of this Directive, on the basis of both qualitative and quantitative information, including in particular, the evaluation of its impact on the cooperation in criminal matters and the protection of individuals, as well as the execution of the provisions on the interception of telecommunications in light of technical developments.

When adopting delegated or implementing acts, the Commission should take due account of the standards and technical specifications drawn up by European and international standardisation organisations and bodies, in particular the European Committee for Standardisation (CEN), the European Telecommunications Standards Institute (ETSI), the International Organisation for Standardisation (ISO) and the International Telecommunication Union (ITU), with a view to ensuring a high level of security and interoperability of electronic identification and trust services.

(6) À la lumière des évolutions qui ont marqué le processus de libéralisation et l'ouverture progressive des marchés des télécommunications en Europe depuis 1990, certaines définitions utilisées dans la directive 90/388/CEE et dans ses actes modificatifs doivent être modifiées pour refléter les derniers développements technologiques dans le secteur des télécommunications, ou remplacées afin de tenir compte du phénomène de convergence qui a redessiné, au cours de ces dernières années, les contours des industries de l'informatique, des médias et des télécommunications.
(6) In the light of the developments which have marked the liberalisation process and the gradual opening of the telecommunications markets in Europe since 1990, certain definitions used in Directive 90/388/EEC and its amending acts should be adjusted in order to reflect the latest technological developments in the telecommunications field, or replaced in order to take account of the convergence phenomenon which has shaped the information technology, media and telecommunications industries over recent years.

(7) considérant que les communications mobiles et sans fil ont une importance stratégique non seulement pour le développement du secteur des télécommunications de la Communauté et pour la société de l'information, mais aussi pour l'économie et pour l'emploi dans la Communauté en général; que la Commission a adopté, le 3 décembre 1997, un livre vert sur la convergence des secteurs des télécommunications, des médias et des technologies de l'information, et les implications pour la réglementation; que, sur la base des consultations faisant suite à la publication de ce livre vert, la Commission tiendra compte des incidences de cette convergence sur l'UMTS, eu égard notamment au réexamen d'ici à 1999 de la réglementation communautaire dans le domaine des télécommunications;
(7) Whereas mobile and wireless communications are of strategic importance both for the development of the Community telecommunications industry and the information society as well as for the economy and employment in the Community as a whole; whereas on 3 December 1997 the Commission adopted a Green Paper on the convergence of the telecommunications, media and information technology sectors, and the implications for regulation; whereas on the basis of the consultations resulting from that Green Paper, the Commission will take into consideration the impact of convergence on UMTS considering, in particular, the review of Community telecommunications regulation by 1999;

(24) considérant que l'abolition des droits spéciaux et exclusifs sur le marché des télécommunications permettra à des entreprises bénéficiant de tels droits dans des secteurs autres que celui des télécommunications de prendre pied sur ce marché; que, afin de permettre le contrôle en vertu des règles pertinentes du traité, d'éventuelles subventions croisées abusives entre, d'une part, les domaines dans lesquels les fournisseurs de services ou d'infrastructures de télécommunications bénéficient de droits spéciaux ou exclusifs et, d'autre part, leurs activités sur le marché des télécommunications, les États membres devraient prendre les mesures nécessaires pour réaliser la transparence quant à l'utilisation des ressources provenant de ces domaines d'activités protégés pour pouvoir accéder au marché des télécommunications libéralisé; qu'il sera nécessaire, pour ce faire, d'imposer au minimum à ces entreprises de tenir, dès qu'elles réalisent un chiffre d'affaire significatif dans le marché concerné de la fourniture de services ou d'infrastructure de télécommunications, des comptes financiers distincts qui fassent apparaître séparément les produits et les charges liés aux services fournis en vertu de leurs droits spéciaux et exclusifs et ceux liés aux services fournis en situation de concurrence; que, à l'heure actuelle, un chiffre d'affaires de plus de 50 millions d'écus peut être considéré comme un chiffre d'affaires significatif;
(24) The abolition of special and exclusive rights in the telecommunications markets will allow undertakings enjoying special and exclusive rights in sectors other than telecommunications to enter the telecommunications markets. In order to allow for monitoring under the applicable rules of the Treaty of possible anti-competitive cross-subsidies between, on the one hand, areas for which providers of telecommunications services or telecommunications infrastructures enjoy special or exclusive rights and, on the other, their business as telecommunications providers, Member States should take the appropriate measures to achieve transparency as regards the use of resources from such protected activities to enter in the liberalized telecommunications market. Member States should at least require such undertakings once they achieve a significant turnover in the relevant telecommunications service and/or infrastructure provision market, to keep separate financial records, distinguishing between inter alia, costs and revenues associated with the provision of services under their special and exclusive rights and those provided under competitive conditions. For the time being, a turnover of more than ECU 50 million could be considered as a significant turnover.

considérant que la Communauté attache une très grande importance à la croissance continue des services de télécommunications transfrontaliers, à la contribution que les services de télécommunications prestés par les sociétés ou personnes physiques établies dans un État membre peuvent apporter à la croissance du marché communautaire, ainsi qu'à la participation accrue des prestataires de services de la Communauté aux marchés de pays tiers; qu'il sera dès lors nécessaire, lorsque des directives spécifiques auront été élaborées, de s'assurer que ces objectifs seront pris en compte afin que l'on parvienne à une situation où la réalisation progressive du marché intérieur des services de télécommunications s'accompagne, s'il y a lieu, d'une ouverture réciproque des marchés d'autres pays;
Whereas the Community attaches very great importance to the continued growth of cross-border telecommunications services, to the contribution that telecommunications services provided by companies, firms or natural persons established in a Member State may make to the growth of the Community market, and to the increased participation of Community service providers in third country markets; whereas it will therefore be necessary, as specific Directives are drawn up, to ensure that these objectives are taken into account with a view to reaching a situation where the progressive realization of the internal market for telecommunications services will, where appropriate, be accompanied by reciprocal market opening in other countries;
