Afin d’éviter des situations dans lesquelles les opérateurs créent artificiellement les conditions pour obtenir des aides de l’Union en vue d’obtenir des avantages contraires aux objectifs visés au règlement (CE) no 1234/2007, il convient d’exiger des États membres qu’ils établissent des règles pour empêcher les producteurs de passer d’un groupement de producteurs à un autre et de bénéficier ainsi de l’aide de l’Union pour une durée supérieure à celle visée à l’article 125 sexies, paragraphe 1, du règlement (CE) no 1234/2007 et pour empêcher les États membres de reconnaître les entités juridiques ou toute partie clairement définie de ces entités en tant que groupements de producteurs, lorsque ces entités peuvent déjà répondre aux critères de reconnaissance applicables aux organisations de producteurs.
In order to prevent situations in which operators artificially create the conditions for obtaining payments of Union aid, with a view to obtain advantages contrary to the objectives of Regulation (EC) No 1234/2007, it is appropriate to require Member States to lay down rules in order to prevent producers from shifting from one producer group to another with the aim to benefit from Union aid for a longer period than the period referred to in Article 125e(1) of Regulation (EC) No 1234/2007 and to prevent Member States from recognising legal entities or clearly defined parts of such entities as producer groups, where such entities could already meet the recognition criteria for producer organisations.

In laying down the minimum number of members of a producer organisation pursuant to Article 4(1)(b) of Regulation (EC) No 1182/2007, Member States may provide that where an applicant for recognition is wholly or partly made up of members which are themselves legal entities or clearly defined parts of legal entities made up of producers, the minimum number of producers may be calculated on the basis of the number of producers associated with each of the legal entities or clearly defined parts of legal entities.

1. 1. For the purposes of this Regulation, a producer group shall be any legal entity or clearly defined part of a legal entity which is formed on the initiative of farmers within the meaning of Article 2(a) of Regulation (EC) No 1782/2003, who are growers of one or more products listed in Article 1(2) of Regulation (EC) No 2200/96 and/or of such products intended solely for processing, with a view to being recognised as a producer organisation.
