Stresses that the recurrent shortages of payment appropriations have been the main cause of the unprecedentedly high level of RALs especially in the last years of the 2007 -2013 MFF; notes with deep concern that the Commission is finding it increasingly difficult to meet all requests for payments in the year within the budget appropriations for payment and that the cumulative total of commitment appropriations available for payments over the period 2007-2013 has exceeded the cumulative total of payment appropriations available over the same period by EUR 114 billon; notes that this is EUR 64 billion more than the difference of EUR 50 billion between the total of commitment appropriations and payment appropriations envisaged in the financial framework;

Recalls that, due to the intransigent position of the Council in the negotiations, the overall level of payments set in the 2013 budget is EUR 5 billion lower than the Commission’s estimates for payment needs in the draft budget; underlines that the Commission’s proposal was based on a revision downwards of the 2013 forecasts provided by Member States themselves and on the assumption that all payment claims to be received in 2012 would be paid out of the 2012 budget; is therefore extremely worried about the level of payments in the 2013 budget and points out that this level of appropriations will be insufficient to cover actual payment needs in 2013 as the margin of payments left below the MFF payments ceiling in the 2013 budget amounts to EUR 11,2 billion while the carryover alone of additional payment needs from 2012 is over EUR 16 billion; warns that continued and excessive deferral of payments on an annual basis will create significant problems for future years;

It draws three main conclusions from the audit work it has carried out: - the accounts accurately reflect the revenue and expenditure, as well as the financial situation, of the Union, although their informative value could still be improved; - the Court has not found any significant errors concerning the legality and regularity of the underlying revenue-related transactions, or any serious substantial errors relating to commitments; - the serious substantial errors (the most probable extrapolated value of which amounts to ECU 2 400 million, i.e. 4% of total payments) found in the transactions underlying the payments entered in the accounts prevent the Court from giving an assurance as to the legality/regularity of all transactions.
